Hi Liz,
I scanned and attached the contents of the registration file. It is not very helpful. As you will see, the original registration
form was submitted in the name of “Brown’s Service Center.” There is another document with Jesse W. Brown’s
signature as “owner.” There are no documents that include the name or signature of Jesse H. Brown.
As far as I can tell, this facility was never issued a permit nor paid any fees.
As you will see in the attachment, there is a handwritten letter in the file that states the store was turned into a dwelling
in 1986, and that is my best guess for how we got that temporary closure date.
Unfortunately, this facility came into the program long before we required more extensive installation, ownership, and
temporary closure documentation.

Hey Andria, I originally sent these questions to Annette by then I was told that Annette may not be the correct
person to be directing these questions to. Hopefully, after you answer these questions, CAB or State Lead will
deal with the incident that came from the subject facility.
I can only see so much on the Registration and Permitting database, any I was hoping you could fill me in on:
1.) Were the tanks actually registered to Jesse W. Brown and/or Brown’s Service Center? If so, when did
he register the tanks? Is there any actual paper work for this facility when it comes to registration and
permitting?
2.) Did Jesse W. Brown and/or Brown’s Service Center ever pay tank fees on these tanks? If so, through
what year range did fees get paid?
3.) Do we know who installed the tanks? I have a property deed that shows Jesse H. Brown buying the
property in 1984 and tanks were reported on your database to have been installed in 1980/1981.
4.) How do you know that tanks were placed in temporary closure in 1986 as stated on your database.

The reason that I am being so hesitant on this one is b/c the son (Jesse H. Brown) bought the property in 1984,
not the father (Jesse W. Brown – who is now deceased).
If the father did submit paper work that he was the tank owner/operator, I’d feel much better about sending
this site to State Lead as the RP is deseased.
I did talk to Gina Williams today and she says that the PIBS protocol is to send to enforcement 3 times and
then send to abandoned tanks. So I do understand that part of it.

I was wondering if you could help me out with some information. The Abandoned Tanks Program pulled the
tanks at the subject facility and I am working on sending the site to state lead, as contamination was detected.
I can only see so much on the Registration and Permitting database, any I was hoping you could fill me in on:

Hi Liz,
PIB attempted to enforce against Brown’s Service Center LLC multiple times but did not proceed with further
enforcement action since Brown’s Service Center did not respond to our notices. So due to the presence of wells in the
area, the site was referred to the abandoned tank contract. I will follow up with Ruth to see if cost recovery is
warranted. But to address your current issue: you all can try to enforce against the LLC for the next phase of work.
Hopefully you will have better luck than PIB!

This site went through enforcement with PIB so I’ll need to confer with Ruth to answer your questions. I know the site
was referred to the abandoned tank contract after an unsuccessful enforcement but I’m not certain of the details
involved. It may be that the corporation came back into compliance with NCSOS after the enforcement case. I’ll get back

Hi Leann,
I was given a UST Closure/Removal Report for the subject site. Andria Archer with PIBS had the tanks
removed with State Funds. It appears that the company that had the tanks registered is viable (the company
did dissolve in 2015 but was reinstated in 2020, reinstatement doc attached)
Has there been a financial review completed and that is why the state paid for the tank removal?
Asking these questions to determine if I send this site to the State Lead Program for cleanup or if I direct the
viable company to cleanup.
Or Andria, is Browns Service Center different than the registered Brown’s Service Center LLC that is viable? I
can only see in the PIBS database that the facility owner was Brown’s Service Center, you may have more info.
on forms I can not see.

Hi Liz,
I was just talking to Ruth about this site. For abandoned tank contract work, we don’t go too far from the site to identify
wells or who is connected to municipal water, nor does our contractor. She was thinking it would need a limited site
assessment if a comprehensive receptor survey is needed. Inspectors note what they observe at the time of inspection,
so PIB info may not be up‐to‐date nor is it comprehensive.

Great question. That information was submitted to me in 2020 after a routine regulatory inspection and was based on
visual observation by the inspector. I don’t have any other information about the wells. Sorry I’m not more help!

Hi Andria,
I’m finally getting into the report submitted for UST Closure at the subject site. Within the report submitted by WI, it
states that “According to information provided by the UST Section, two active water supply wells are currently located

on the adjacent property to the east of the site.” I do see the wells at the House of Raeford on out GIS database that are
being referred to.
Do you happen to have other information pertaining to water supply wells at this site. Is there public water available on
site and in the area?
Thanks for any information you can give me concerning drinking water in this area.
