PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up
STATUS OF PAST NOTED VIOLATIONS:

OBSERVED VIOLATIONS: NA
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell, with the Section, followed up on corrective actions at the YWN. Temporary Disaster Debris
Site, TDDS, DS78-035, next to notification. Waste was previously taken into the area of the TDDS and the Town of Red Springs was instructed to remove the waste. During this inspection most of the waste has been removed. However, in the two locations, mulched yard waste was spread out in the same area along with much trash such as plastic and clothing etc. This site is not approved for this waste and should be removed immediately to the appropriate landfill site for that waste type. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
3. Wetland area has had all waste removed. T posts marking the ~ wetland area plus a 50 ft buffer are in place but the string has fallen. Be sure to keep all traffic, waste, vehicles etc. out of the wetland area.

4. The site was gated, and the gate was closed upon arrival. Mr. Powell walked from the road entrance into site to do inspection. Newer YW now has good row separation. Good job.

5. Previously, the older YW was mulched and windrowed into an area outside of the notification and where the disaster debris site (DS78-035) was designated. This is not an approved activity. The Town was instructed in the previous inspection (2/9/2023) to remove the YW to an appropriate disposal site. Weight tickets were provided by Mr. Edge on 3/27/2023 for disposal at the Robeson County Landfill. However, upon follow up inspection, not all the mulched YW was removed. It was spread out across a large area along with comingled MSW waste such as plastics and clothing. All waste needs removal to soil, disposal at the
appropriate disposal site for that waste type, documentation provided to the Section within 30 days of receipt of this inspection report, or a Notice of Violation will be sent.

Second location near access road. (Inside TDDS) 6. DS78-035 - In the event of a disaster, as with any Temporary Disaster Debris Site (TDDS), and you call
or email to activate the debris site, be sure to the disaster debris separate from YW material. Any storm related waste, once site is activated during an emergency, will need to be separated from weekly YW collection. 7. Corrective measures are necessary as result of this inspection and should be completed within 30 days of receipt of this inspection report. A follow up compliance inspection will be conducted by Solid Waste Section Staff within about 30 days, or shortly after, receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
