PURPOSE OF SITE VISIT: Comprehensive Inspection – CLOSURE OF YARD WASTE NOTIFICATION
STATUS OF PAST NOTED VIOLATIONS:
1. 15A NCAC 13B .1402 (g) -RESOLVED
OBSERVED VIOLATIONS: NA
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Mr. Powell inspected the YWN to check on progress and conditions of the site. Mr. Powell didn’t meet with
any Town staff during inspection. The YWN has had all waste removed and weight tickets for disposal provided. Good job. This Yard Waste Notification is CLOSED and can no longer accept waste of any kind. The Town should communicate with Pre-Regulatory Landfill Group Supervisor Ryan Channel. Please save all documentation in Town records.

2. Illegal site IS782204 behind wastewater treatment plant had waste removed and photos/weight ticket documentation sent to Section. Town is awaiting a trailer from the County to arrive for disposing of tire pile. Once tires have been removed to proper disposal site and documentation provided, violations can be resolved with that illegal site. A photo of the tires stockpile location, cleaned up, should be provided as well via email to Mr. Powell.

Vegetative waste was removed from the side of access road before YWN. 3. If the Town wishes to manage disaster debris from an emergency, such as during Hurricane or Tornados, then it needs a TDDS approved site to operate upon. It also depends on how they plan to manage this waste. For example, will it be just vegetative waste or C and D? If just vegetative, then will this area be just for staging and hauling or will it be to grind and then haul to a landfill for utilizing with soil as cover for them? The Town needs to decide what it wants to do and how it can do it. Other options the Town could
potentially have would be to set up a prearranged street pickup contractor for use during such events, and they haul direct to the appropriate disposal site for that waste type. The town wouldn’t need a site or have to manage the waste, just ensure it went to a proper disposal site. Discussions have been to possibly look at the area around the WWTP. The Town should be looking for a backup location as well. First, the Town needs to decide and let Mr. Powell know what it wishes to do, and how it wants to do it. Then the process can begin for possibly approving any locations. Mr. Powell emailed the link to the Sections website, and guidance documents were attached, on 4/3/2023. 4. Corrective measures are necessary as a result of this inspection for IS782204. Failure to meet the conditions for compliance may result in further Compliance Actions. The Yard Waste Notification YWN-78-002 is CLOSED and this site cannot accept waste of any kind. The Pre-Regulatory Landfill should not be disturbed and the PRLF group/Ryan Channel contacted on next steps.
