Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility ceased operation as of July 1, 1993. 2. Multiple gates were located along the entrance road to the landfill preventing unauthorized access. 3. The landfill was stabilized with native vegetation. 4. Cattle are allowed to graze on the landfill. During the inspection, a small area of settling was observed on the west side of the landfill. It appeared that cattle had been bedding down in this area. It was requested that this area be filled and stabilized with groundcover. On March 29, 2023, Ms. Anderia Byrd submitted a photo of the subject area via e-mail. The photo showed the area had been filled with soil, and Ms. Byrd noted the disturbed area had been seeded as well. Thank you for attention in this matter. x Please continue to monitor the landfill cap for signs of damage caused by cattle grazing and repair any areas of damage as needed. x No additional significant settling was observed on the landfill. 5. Minor rutting from vehicle traffic was observed on the landfill near MW-2. Please ensure the damage is repaired and stabilized with groundcover sufficient to restrain erosion. 6. No trees or dense brush was observed growing on the landfill. 7. Edge-of-waste markers consisting of t-posts were in place around the perimeter of the landfill at the time of inspection. However, additional t-posts were observed leading up the center of the landfill which did not correspond to the site survey recorded with the Catawba County Register of Deeds on April 28, 2011 in Book: 00011; Page 0175. A copy of the landfill survey was sent to Ms. Byrd via e-mail on March 23, 2023. It was requested that Wilkes County staff verify the original edge of waste as detailed in the landfill survey and ensure the landfill footprint is permanently marked. x The Solid Waste Section received an e-mail from Ms. Byrd on March 29, 2023 in which Ms. Byrd explained all but 3 of the 18 t-posts indicated on the landfill survey had been located. Ms. Byrd further explained that staff were continuing work to locate the remaining three posts, and the Solid Waste Section would be notified once all remaining posts were located. Thank you for your efforts so far to address this concern. 8. Semi-annual groundwater monitoring was being performed as required. 9. During the inspection, groundwater monitoring wells MW-1, MW-2, and MW-3 were observed. x An unobstructed path was provided to all monitoring wells. x All wells were locked and a concrete pad had been provided at all three wells since the last inspection. However, the following concerns were observed. ™ MW-3 had no information provided on the metal tag attached to the metal casing. Please ensure the tag is replaced or proper information provided as required by 15A NCAC 02C .0108(p). ™ The concrete pad for MW-1 was in need of repair. It appeared the concrete form was damaged during installation allowing some concrete to spill. 10. Methane monitoring was being performed quarterly as required. x Wilkes County continues to address methane exceedances above the lower explosive limit at the north property boundary. x A Landfill Gas Remediation Plan Status Update Report was submitted by LaBella on March 16, 2022 and approved by the Solid Waste Section on March 21, 2022. Since approval of the status update report, eight (8) temporary gas probes were installed along the northern property boundary on June 13, 2022. The probes have been monitored quarterly since installation. As noted in the approval for the status update report, a landfill gas delineation study report with any proposed recommendations must be submitted within 60-days of completing of one year of quarterly monitoring of the gas probes.
