In accordance with 130A-294 (a2) this permit is for the life-of-site. Life-of-site ends when the facility reaches its final permitted elevations or by December 17, 2057. The thirty year (30) term of the franchise agreement between the City of Fayetteville and Cumberland County was executed on October 6, 2008 and ending on October 6, 2038 (DIN 26324). PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 OBSERVED VIOLATIONS: NA ADDITIONAL COMMENTS 1. David Powell, and other inspectors with the Section, met with Cumberland County Solid Waste (CCSW) staff to view the Landfill Reclamation Pilot Project (Bale Fill Project) startup at the Closed MSW, under the CDLF. The Active MSW was briefly inspected during the Section staffs visit to Ann St Landfill. Operations are still in Cell 9/10 on the North end of landfill. The working face was small, and a tarp was available to cover. Mulch and soil are being used as well. The top dressing of mulch was visible on top of soil bare areas to assist with erosion control and to encourage vegetation growth. Before staff left the landfill, a new compactor was arriving onsite. Active working face viewed from older closed cells. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Soil cover in place, there are several stockpiles of mulch/soil mix for additional cover and erosion control waiting to be spread out. There were some windblown waste issues on top of the older cells and some around active cells, please address. Seep repair areas were visible as well. Good job on repairing, but additional repairs may be needed with some seeps along access road to top of closed cells of MSW. Document repairs in daily logs. Most side slopes were in good shape. Vegetation was established and no erosion visible across most of the side slopes. Good job. Access road to top of older MSW cells. The last records inspection indicated that it was currently scheduled to be inspected again, meeting the 5-year requirement, please follow through. Ground water and methane wells that were visible along the perimeter roadway seemed to be locked, with lids, and in good condition. These will be inspected more in depth in the comprehensive inspection. 5. Concrete crushing and staging area will be addressed in CDLF/Closed MSW inspection report. 6. Ms. Bader and Mr. Smith described plans to add constructed wetlands to stormwater structures onsite around the landfills and this would be implemented very soon. 7. Corrective measures are necessary as a result of this inspection. A follow-up inspection will be conducted by Solid Waste Section Staff. Communicate with DWM Section permitting, DEMLR for stormwater and DWR on issues at concrete area. Failure to meet the conditions for compliance may result in Compliance Actions.
