RESOLVED. 15A NCAC 02C .0108(1) states, "all non -water supply wells, including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and use." During the previous inspection on October 6, 2022, Davidson County was in violation of 15A NCAC 02C .0108(1) for failing to secure the locking well cap. During the inspection monitoring well MW-12 was observed to be secured with a lock. OBSERVED VIOLATIONS: None. Page 1 of 2 NORTH CARnLINAD_E Q�� oen.mmem m c.w.mmen.i a.i� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The Davidson County Landfill facility includes an active MSW landfill, a closed MSW landfill, a closed C&D landfill, a permanent HHW collection site, a convenience area, an electronics collection area, a scrap tire collection area, and a white goods collection area. The closed landfills were not inspected during this site visit. 2. Proper signage was observed at the facility entrance. 3. The site is secured by perimeter fencing with a locking gate to secure the entrance. 4. Facility access roadways are of all-weather construction and appeared to be in good condition at the time of inspection. 5. Windblown litter was observed to be minimal and well managed. During the inspection wind speeds at the facility were high and windblown litter was observed around the working face where wind fences were set up to help control the litter. Litter crews were observed on -site managing the windblown litter. 6. The leachate storage tank was inspected and found to be intact with no leaks were evident. 7. The active landfill side slopes appeared to be in good condition with vegetative cover. 8. The inactive portion of Phase 2 landfill was also inspected. The landfill top was observed to be in good condition with no ponding water. The slopes of the inactive landfill were observed to be in good condition with vegetative cover with no evidence of leachate seeps observed. 9. During the inspection an area on the side slope was observed to have been repaired. Facility staff stated that a leachate seep had been found and repaired by removing the cause, a mattress. 10. The working face was found to be small and well contained. Facility staff had stockpiled cover soils near the outer limits of the working face in preparation for applying cover at the end of the operating day. A spotter was observed directing traffic to keep the tipping area clear and to allow space for trucks to maneuver. No unacceptable materials were observed in the working face.
