Queen Street Edenton, NC 27932 Re: Notice of Regulatory Requirements 15A NCAC 2L .0407 Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Acknowledgement of Report Receipt Perrytown Service Center 526 Sand Hill Road, Colerain Bertie County Incident Number: 13261 Risk Classification: High Ranking: 134 R Dear Mr. Simonsen: The Division of Waste Management (DWM) Underground Storage Tank (UST) received the June 2020 Groundwater Monitoring Report for the subject site. Please note the following comments; • Neither free product nor GCL contamination was observed during this sampling event, however RW1 appears to be alternating between lower concentrations and minor free product. • Perimeter monitoring wells, with a few exceptions, now indicate a limit to contaminant migration. • From MW 25 in a westerly direction parallel to Perrytown Road, may be a preferred path of contaminant migration. Investigation should be discussed before the next sample event. • Repeat a limited sampling event in December 2020, excluding monitoring wells MW2, 3, 11, 12, 22, 23, 24. • A plume stability analysis was completed in October 2029 showed MW2 and 27 were declining, MW10 is likely decreasing, and no trend indicated for MWs 25 and 26. • Although the report states the June sampling was conducted per the NORR issued, water supply wells WSW2 and WSW14 were not sampled. • Is there any additional information on possible removal of the USTs on-site that have been in temporary closure for a number of years? Because a release or discharge has been confirmed, a Licensed Geologist or a Professional Engineer, certified by the State of North Carolina, is required to prepare and certify all reports submitted to the Department in accordance with Title 15A NCAC 2L .0103(e) and 2L .0111(b). Please note that before you sell, transfer, or request a “No Further Action” determination for a property that has not been remediated to below “unrestricted use” standards, you must file a Notice of Residual Petroleum ("Notice") with the Register of Deeds in the county where the property is located (NCGS 143B-279.9 and 143B-279.11). Failure to comply with the State's rules in the manner and time specified may result in the assessment of civil penalties and/or the use of other enforcement mechanisms.
