Congleton Stokes & Congleton, Inc. 3609 Hawick Place Greenville, NC 27834-0439 Re: Notice of Regulatory Requirements 15A NCAC 2L .0407(c) [High Risk] Risk-based Assessment and Corrective Action For Petroleum Underground Storage Tanks Stokes & Congleton 2809 NC Hwy 903 N, Stokes, NC Pitt County Incident Number: 13128 Risk Classification: High Ranking: H 0155 R Dear Mr. Congleton: The Underground Storage Tank (UST) Section, Division of Waste Management, Department of Environmental Quality (Department) has received the Monitoring Report for Ground-Water Sampling, dated April 13, 2022, documenting a groundwater sampling event conducted onsite on March 3, 2022. During this most recent sampling event, a measurable thickness of non-aqueous phase liquids (NAPL) was not detected in monitoring wells MW-4 or AECMW-11, but a sheen was reportedly observed on the purge water generated during the sampling of these wells. For these and other monitoring wells, petroleum compounds were reportedly detected in the groundwater samples at concentrations that exceed the applicable groundwater quality standards defined in Title 15A of the North Carolina Administrative Code Subchapter 2L .0202. Additionally, though detected during the prior sampling event, petroleum hydrocarbons were not reported in the analysis of the water sample collected from the onsite public water supply connection (TAP-1) during this event. The site remains classified High Risk until these trends remain consistent over multiple events. For this reason, you must conduct a semiannual monitoring event during the third quarter of 2022 and submit a report documenting the findings from this event no later than October 31, 2022. Effective October 1, 2004, the Department requires that all work not determined to be an emergency response or associated with risk assessment (i.e., the Limited Site Assessment Report, per Title 15A NCAC 2L .0405) must be preapproved if Commercial Leaking Petroleum Underground Storage Tank Cleanup Fund (State Trust Fund) reimbursement is anticipated. To comply with this requirement, a completed Preapproval/Claim Authorization Form encompassing the scope of work described above must be received and approved by this office well prior to the start of any tasks for which you intend to seek reimbursement. Upon completion of any preapproved activities, you should submit your claim promptly. Reimbursement funds are budgeted based on completed preapprovals but delays in reimbursement or even denial due to a failure to meet the statute of limitations on claiming a completed task can result if the work is not completed in a timely fashion or if claims are not submitted immediately following work completion.
