On behalf of MVC, LLC, and in response to the February 1, 2006, Notice of Violation
issued by the Mooresville Regional Office (MRO) of the Division of Water Quality
(DWQ), MVC intends to comply with requirements of the Oil Pollution and Hazardous
Substance Control Act (Act). The proposed plan of action includes excavating an
estimated 10 to 15 cubic yards of petroleum contaminated soils, collecting post
excavation samples to demonstrate that all of the impacted soils above the action levels
have been removed, backfilling the excavations and transporting them to an off-site
permitted treatment/ disposal facility. A written report documenting these activities will
be submitted to your section by May 2, 2006. If you require any additional information,
