Therefore, F&R is requesting, on behalf of Westfield Homes, the site be closed and a "No Further Action" letter be provided for the site. The initial abatement activities performed or arranged by F&R personnel included the following: 6.75 Acre Tract 1100 Block, Harris Road Cabarrus County, North Carolina 20-Day Report F&R Project No. G63-9039E March 7, 2006 SINCE [@1 I 8 81 ► Preparation of an initial abatement plan, ► Prepare a waste characterization of the soil to be removed, ► Arrange for the mobilization of a sub-contractor to the site with excavation and sampling equipment to remove approximately 10 to 15 cubic yards of impacted soil, ► Post sampling the in-situ soils after impacted soil removal for laboratory analysis, and ► Transportation of a suitable clean soil to backfill the excavated areas. 3.0 SITE HISTORY The subject site is located north of the intersection of Harris Road and Ellenwood Road in Cabarrus county, North Carolina as shown on Drawings Nos. 1 and 2 in Appendix I. During F&R's field services in August 2005 for a geotechnical study, hydrocarbon odors were noted in the soil samples collected at five of the ten soil borings performed at the site. Based upon the conditions noted, F&R environmental personnel were authorized to return to the site in October 2005 to obtain soil samples for laboratory testing. Three soil samples were obtained in the vicinity of the previous sampling locations (Drawing No. 2) and submitted to a North Carolina accredited laboratory for laboratory analysis. The three soil samples were analyzed for total petroleum hydrocarbons (TPH) by EPA methods 3550, 5030, and 9071. In addition, one soil sample was analyzed for volatile organic compounds (VOCs) by EPA method 8260 and semi-volatile organic compounds (SVOCs) by EPA method 8270. Based upon the laboratory results, concentrations of diesel range organics (method 3550), gasoline range organics (method 5030), and SVOCs (method 8270) were not detected above the laboratory detection limit. VOCs (method 8260) were not detected above the laboratory detection limit with one exception; acetone was detected at a concentration of 0.0666 milligrams per kilograms (mg/kg). The concentration of acetone concentration did not exceed the Soil-to-Water Maximum Contaminant Concentration (S-W MCC) or the Residential Soil Clean-up Level (RSCL). However, at two of the three sampling locations, it appeared that the soils had been impacted with oil and grease compounds in excess of the North Carolina Department of Environment and Natural Resources (NCDENR) "action" level of 250 parts per million (ppm) as shown below. Based upon of the information supplied to the MRO, an NOV dated February 1, 2006 was issued to MCV LLC. A copy of the NOV is presented in Appendix III. 6.75 Acre Tract 1100 Block, Harris Road Cabarrus County, North Carolina 2 20-Day Report F&R Project No. G63-9039E March 7, 2006 SIN CE @ 1 881 4.0 SOURCE INVESTIGATIONS 4.1 SOIL SAMPLE COLLECTION PRIOR To SOIL EXCAVATION Prior to the excavation and removal of the impacted soils, F&R personnel collected a composite sample on February 8, 2006 for waste characterization analysis required by the proposed soil disposal facility. The composite sample was comprised of soil obtained from a hand auger boring performed adjacent to the previous hand auger boring locations. The composite sample was analyzed for RCRA Metals. The laboratory analysis indicated that barium, cadmium, chromium, and selenium were present and that the chromium concentration exceeded the Soil- to-Water Maximum Contaminant Concentration (S-W M CC) but did not exceed the Residential Soil Clean-up Level (RSCL). 4.2 SOIL EXCAVATION On February 17, 2006, 12.59 tons of impacted soil was excavated from two pit locations in the areas of SS-2 and SS-3 at the site as shown on Drawing No. 3. The excavated soil was placed directly into a dump-truck and transported to the BFI Landfill on Morehead Road in Cabarrus County for disposal. A copy of the Non-hazardous Manifest for the soil is presented in Appendix IV. After excavation of the impacted soil, two soil samples (Samples A & B from Pit #1 and Samples C & D from Pit #2) were collected from each excavation. One sample was collected from the side-wall of the excavation and one sample was collected from the bottom of the excavation pits. The laboratory was requested to analyze the samples for Oil and Grease and Total Chromium. The location of the soil samples and the analytical results are illustrated on Drawing No. 3. 4.3 QUALITY CONTROL MEASURES The soil samples were obtained as specified in the collection, preservation, and handling section of the specific method. Each container was labeled with sample location, analyses to be performed, time, date, and the sampler's name. It was then placed in a cooler and chilled with ice to approximately 4°C in preparation for transportation to the analytical laboratory, utilizing EPA approved chain of custody procedures. The samples were delivered to the lab on the day following the sampling event. 4.4 INVESTIGATION RESULTS Based upon a review of the laboratory data (Appendix V) for the samples submitted to the laboratory, it appears that a sufficient quantity of impacted soil was removed in the areas of concern. The laboratory results for the samples verify the concentration of the in-situ soils are below the 250 mg/kg Action Level for Oil & Grease and below the 27 mg/kg S-W MSCC for Total Chromium. The laboratory results are summarized in Table 1 presented in Appendix I. Based upon the findings of this report, it appears the impacted soils at the site have been removed from the site and concentrations of constituents of concern are below the NC "Action" Level, the S-W MSCC and the RSCL. The Division of Water Quality (OWQ) has the delegated authority to enforce adopted pollution control rules and regulations. Based upon the environmental site assessment report received in this office on January 26, 2000, the DWQ has reason to believe that you are responsible for activities resulting in noncompliance with North Carolina law. The specific violations of General Statute 143-215.75 et seq., Oil Pollution and Hazardous Substances Control Act, are as follows: 1, G,S. 143-215.83 (a) Unlaviful Discharges: It shall be unlawful for any person to discharge oil or other hazardous substances into or upon any waters or land within the state; 2.
