In reviewing the incident file and the January 15, 2019 letter to Leviton from this office (me) in response to the December 18, 2018 Annual Groundwater Sampling Report by Excel Civil & Environmental Associates, I have come to realize I was in error when I put forth the following: 1. The subject incident does not meet the requirements for further assessment or corrective action according to Carolina General Statute (NCGS) 143-215.94E(e4). 2. It is possible to receive a final no further action determination for the subject incident from the UST Section by completing a Notice of Residual Petroleum and public notice for groundwater contamination. 3. The priority ranking of the site is low/industrial commercial according to NCAC Title 15A, Subchapter 2L, Section .0400. As the items listed above only apply to sites with petroleum contamination, they do not apply to the subject site since none of the contaminants there are strictly petroleum-based. According to NCAC Title 15A, Subchapter 2L, Section .0106, corrective action, including active remediation and monitoring, must be continued at the site. Specifically, the remediation system must remain active and groundwater monitoring must be continued. Be advised that active remediation may be discontinued, or the corrective action plan may be terminated if the requirements detailed in NCAC Title 15A, Subchapter 2L, Section .0106(l) or Section .0106(m), respectively, can be met to the satisfaction of this office. I urge you or your consultant contact me to discuss your options should you decide to consider seeking approval to discontinue active remediation or terminate the corrective action plan.
