The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS 1. Andrew Hammonds and David Powell, Solid Waste Section, met with landfill owner Bo Frizzell for a compliance inspection and to discuss permitting LCID and expansion. Site has gate and signage at entrance. Mr. Frizzell had some consultants, and engineer firm representatives meet onsite to discuss rules, plans, and needs for possible
expansion. Mr. Frizzell has been in communication with DEMLR Nick Mills, for the mine and sedimentation and erosion control, and should communicate with him on his divisions needs regarding those areas. Mr. Frizzell should also communicate with County on their needs as well. Mr. Frizzell indicated he had acquired additional land surrounding the current NLCID, but additional land was needed to meet buffers for his plans. 2. Facility has EOW markers in place and is mostly covered and sloped well. However, on the north side and northeast corner there is the need for additional cover and sloping 3:1. Soil is staged on top for additional cover. Please fix. Afterwards establish grass across landfill for erosion control. 15A NCAC 13B .0566 (2) - Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.
(3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for soils as defined in G.S. 130A-310.65.

East side slope with EOW markers. Should be 3:1 along northeast corner. 3. Rules were discussed and the need for permitting or closure by January 1, 2026, per new rules. Mr. Frizzell also indicated there was a new arrangement regarding a Solid Waste Enforcement Officer. He explained the SW Officer is now under county Sheriff’s Department. Captain Ford is over the program, with Deputy Barton assigned to this position currently. Mr. Frizzell also shared some information and a couple older photos of a
possible illegal site in the county. The county should respond and follow its Solid Waste Enforcement process that’s established and address accordingly sites such as these and/or any complaints received regarding solid waste issues. Section staff can possibly assist or provide technical assistance, but counties must enforce their own solid waste ordinances. If the County cannot address the violations, if any, with their process, then contact myself and I will assist if possible. Upon discussion later, Mr. Frizzell indicated the county may be updating their solid waste ordinances. This is good idea. Look at neighboring counties for
ideas and address recent years problems within the county and find what works for Scotland best. 4. Access roadway was in pretty good shape except for along the west side up to top. Some exposed waste and unapproved wastes were visible. Please be sure to cover waste, remove unapproved to appropriate disposal site and meet rule requirement for access roads. 15A NCAC 13B .0564 (7) - The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. 15A NCAC 13B .0566 (7) - Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.

North side slope, with exposed waste needing covering. Slopes need to be 3:1. Road access stops and should continue around to west side slope access to meet rule.
Unapproved and exposed wastes along access road to top of NLCID, please address.

5. Mr. Powell emailed Mr. Frizzell the newest rules, on March 14, 2023, along with the October 6, 2021, letter from Section Chief Ed Mussler, regarding closure notification of all Notified Land Clearing and Inert Debris landfills by January 1, 2026. Mr. Frizzell should communicate with Section Permitting, Ming Chao, (919) 707-8251 or ming.chao@ncdenr.gov for applying for a LCID permit.
