STATUS OF PERMIT: Notified LCID PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS 1. A routine inspection was conducted today by Mr. David Powell. Mr. Powell spoke with Mr. Dawson prior to day of inspection and emailed him a copy of the newest rules, on 3/7/2023, along with the October 6, 2021, letter from Section Chief Ed Mussler, regarding closure notification of all Notified Land Clearing and Inert Debris landfills by January 1, 2026. Mr. Dawson has not accepted waste for some time at this NLCID. Mr. Dawson discussed wanting to begin excavating and screening waste to remove soil. This is not permitted for this facility currently, do not excavate or screen waste until get approval from Section. Mr. Dawson inquired about how to permit excavating and mining the NLCID as well as permitting a LCID. Mr. Powell started an email conversation between Section Permitting and Mr. Dawson. 2. Site has locked gate access. Signage should be kept even though waste is not being accepted as this time. Be sure sign meets new rules. 15A NCAC 13B .0566 (14) A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site. 3. Edge of Waste (EOW) markers are still in place. Waste is still well inside the marked area. Waste is close to 100 ft buffer on west side, be sure and not get any closer. Access was previously available around most of LCID, but road has become untravellable in areas along south and east sides. Please fix to meet rule of all-weather construction around entire NLCID. State inspector and fire fighting equipment should be able to get around entirety of NLCID. 15A NCAC 13B .0566 (7) - Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. Northeastern side looking south, with EOW marker and access road needing repair to all weather construction. However, there were areas of some exposed waste needing cover. Be sure when covering all waste is compacted, covered, and sloped 3:1. Site needs mowing as well. 15A NCAC 13B .0566 (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. Southwest side, exposed waste. Southwest side slope, another pile of waste needing compacting and covering. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 6 Southeast side slope needs better cover. 6. Concrete, asphalt and sand are stored onsite. Concrete is crushed often and sold for road base. What concrete was onsite was clean. Metal was being removed and put into a roll off for scrap. However, there are some areas of older concrete onsite, in which vegetation is beginning to grow. All concrete accepted should have 75% crushed and utilized within that calendar year of its acceptance. Older waste needs to be crushed and utilized or hauled to a disposal site for that waste type. Or perhaps not accepting so much concrete waste, as to be able to crush and keep up with the rule requirement. Rule for reference is below. General Statue § 130A-309.05. Regulated wastes; certain exclusions - (c) Recovered material is not subject to regulation as solid waste under this Article. In order for a material that would otherwise be regulated as solid waste to qualify as a recovered material, the Department may require any person who owns or has control over the material to demonstrate that the material meets the requirements of this subsection. In order to protect public health and the environment, the Commission may adopt rules to implement this subsection. Materials that are accumulated speculatively, as that term is defined under 40 Code of Federal Regulations § 261 (July 1, 2014 Edition), shall not qualify as a recovered material, and shall be subject to regulation as solid waste. In order to qualify as a recovered material, the material shall be managed as a valuable commodity in a manner consistent with the desired use or end use, and all of the following conditions shall be met: (1) Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. Failure to meet the conditions for compliance may result in further Compliance Actions.
