OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626(2)(b) states: "Except as provided in Sub -Item (c) of this Item, the owners or operators of
all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating
day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and
scavenging, and to minimize fires and the generation of odors. "
During the March 1, 2023 inspection, exposed waste mixed with soil was observed throughout the top and side
slopes of the landfill cell. As a result, Macon County is in violation of 15A NCAC 13B .1626(2)(b) for failure to
cover all disposed waste with six inches of earthen material at the end of each operating day as required.
To correct the violation, Macon County must immediately cover all exposed waste with at least six inches of
earthen material at the end of each operating day. Follow up inspections will be conducted to ensure

compliance with 15A NCAC 13B .1626(2)(b).
Exposed Waste on Top of Landfill Cell
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on March 1, 2023.
2. The facility is open to the public Monday through Friday, 7:30 am to 4:30 pm, and Saturday, 8:00 am to 2:00
pm.
3. Access roads throughout the facility were of all-weather construction and were being maintained in good
condition at the time of inspection.
Operations Inspection of the MSW Landfill Unit (5703-MSWLF-1992)
4. The facility is currently filling on the northeast side of Phase 3, Cell 1.
5. Exposed waste mixed with soil was observed throughout the top and side slopes of the landfill cell. It appeared
that the exposed waste was from a combination of using the previous days cover in which waste was mixed into
the soil and, waste being deposited by equipment movement over inactive portions of the cell. Covering the
slopes with additional soil and stabilizing them should be a priority. During discussions with landfill staff, the
use of mulch for temporary slope stabilization was encouraged. Mulch that is placed on the side slopes should
be spread at no more than six (6) inches thick, with four (4) inches being optimal. The possibility of adding
seed during the application of mulch could assist in better temporary stabilization. See Observed Violations

6. Two large ruts were observed on the south side slopes of the cell. Facility staff stated that the bulldozer had slid
down the slope and had to be recovered. The ruts in the slopes must be repaired to prevent channels from
forming that could erode the side slopes. Once repaired, it is recommended that a small earthen berm be
maintained along the top of the slopes to prevent erosion of the repaired areas due to runoff from atop the
landfill.
7. Ruts were observed in multiple areas of the landfill cap and appear to be from uncontrolled vehicular traffic.
Traffic should be controlled and limited to the active working face to prevent rutting and waste from being
exposed. All ruts must be repaired to prevent waste from being exposed and water standing on the cap.
8. If equipment is to be stored atop the landfill, please maintain a dedicated area/pad and limit ingress/egress into
the area to prevent damage to already covered areas.
9. The working face was small, compact and no unapproved material was observed.
10. Windblown waste was observed around the entrance to the landfill cell. However, facility staff were actively
picking up windblown waste at the time of inspection. Continue to collect and dispose of all windblown
material as required by 15A NCAC 13B .1626(11).
Operation Inspection of the Waste Treatment and Processing Facility
11. The Waste Treatment and Processing Facility is located to the north of the scale house. This area allows citizens
to drop off municipal solid waste (MSW) and construction and demolition debris in lieu of taking materials
directly to the landfill. Citizens can also drop off electronics, cardboard, scrap metal, plastics, and universal
waste such as fluorescent light bulbs.
12. On the evening of October 4, 2022, the walking floor trailer parked inside the Waste Treatment and Processing
building caught fire destroying the trailer and damaging the building. After the fire, use of the building was
suspended, and all MSW and construction and demolition waste were sent to the working face of the MSW
landfill. The building is now deemed safe for use and operation has resumed. Roll off dumpsters are being used
until a new transfer trailer is purchased.
13. Waste was observed on the ground around the roll off container that was being loaded. Ensure that all waste is
removed from the floor at the end of the operational day.
14. One large pallet was observed on the tipping floor; facility staff also saw the pallet and removed it from the
waste.
15. Fluorescent tubes and bulbs were observed to be stored in structurally sound containers that were adequate to
prevent breakage.
16. Tires are collected in four van trailers outside the building. No tires were observed on the ground at the time of
inspection.
17. The leachate drains were observed to be clear, and the collection system appeared to be working properly.
Operations Inspection of Yard Waste Treatment and Processing Facility
18. The yard waste treatment and processing area is located to the northwest of the active landfill cell.
19. The facility is permitted to receive land clearing waste as defined by 15A NCAC 13B.0101(31), wooden pallets
constructed of unpainted and untreated natural wood and yard trash as defined by 130A-290(a)(45).
20. The yard waste area has an access road around the unground stockpile that can be used by emergency vehicles in
the event of a fire.
21. A small amount of painted wood was observed from what appeared to be a recently dumped load. Continue to
remove any unapproved material that is encountered in incoming loads.
22. The facility has a dumpster staged in the area to collect any unapproved material that is found in incoming loads.
23. No standing water was observed.
24. Fugitive dust was well controlled at the time of inspection.
25. No offensive odors were detected.
Other Comments
26. The leachate pond was observed during the inspection. No visual deficiencies were observed with the visible

portion of the liner.
27. The leachate pond had adequate freeboard at the time of inspection.
28. As discussed, efforts should be made to ensure plastics, paper and other waste is not being allowed to remain on
the ground in the recycling area, where it can come into contact with storm water. Further, storm water should not be
allowed to pond in these areas.
