PURPOSE OF SITE VISIT: Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: A. 15A NCAC 13B .0105 (4), “The vehicle or container body, waste holding area, and hopper, if so equipped, shall be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi-solid, or liquid waste.” CORRECTIVE ACTION IN PROGRESS: At the time of this inspection, significant damage was present on the north side wall of the transfer station building adjacent to the trailer loading bay. The damage consisted of multiple gaping holes in the metal wall paneling through which waste was observed escaping the building. Several of the metal panels had been replaced. Mr. Cotton stated that replacement metal paneling had been ordered for the repair, however, there was a 4-week turnaround time. Ensure damaged metal wall panels are repaired or replaced to prevent the escape of waste or leachate outside the contained area. Temporary FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 measures must be installed to ensure the integrity of this facility and the ability to contain waste and leachate as required. B. 15A NCAC 13B .0405 (a) (11), “Site Cleaning and Maintenance: Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter. The tipping floor, push walls, and truck loading bays shall be cleaned with a pressure washer no less than once per month. The remaining areas of the site building include side walls and any material storage areas outside of the building shall be cleaned with a pressure washer no less than twice per year. Wash water generated from cleaning waste handling areas shall be contained and treated as leachate.” RESOLVED: The wase previously identified behind and on top of the push walls and barriers had been removed. Mr. Cotton stated that the waste is now removed at the end of every day. The waste had also been removed from underneath the metal recyclable container. Mr. Cotton also stated that the facility walls are pressure washed monthly and the tipping floor weekly. Continue to ensure that all waste behind the push walls, barriers, in the maintenance area, and in the transfer trailer loading bay is picked up and disposed of at the end of each operating day. Continue to ensure that the facility and tipping floor are pressure washed in accordance with the rules and operations plans. OBSERVED VIOLATIONS: C. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” During this inspection, leachate was found to be pooling up and flowing out of the western end of the transfer trailer loading bay. The leachate flowed into a stormwater drainage feature and into a catch basin adjacent to the southwestern corner of the transfer trailer loading bay. Black sediment and waste were observed in the downstream northwestern stormwater catch basin and drainage ditch. This area drains into the stormwater detention pond. No leachate was observed flowing into the detention pond at the time of this inspection. Waste buildup was also observed within the stones along the side slopes of the catch basins. Measures should be implemented to ensure leachate is contained within the transfer trailer loading bay and directed into the collection system. Ensure all impacted soils at the end of the loading bay and within the stormwater drainage ditch and catch basins are excavated and disposed of properly. The surface and subsurface soils in the identified areas will need to be evaluated for possible contaminants. Additionally, it may be necessary to evaluate the water within the detention pond for contaminants as well. Please contact Perry Sugg at perry.sugg@ncdenr.gov for sampling guidance. ADDITIONAL COMMENTS The facility is a waste transfer station operated by Republic Services of North Carolina, LLC and is permitted to receive municipal solid waste, construction and demolition waste, inert debris, land clearing debris, and asphalt generated in Wake, Johnston, Durham, Granville, Franklin, Nash, Harnett, Lee, Chatham, and Orange Counties. Incoming loads of MSW and C&D waste are not segregated but combined into transport trailers for disposal at an MSWLF. Stella Environmental Services is subcontracted to perform the daily operations of the transfer station. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 1. The facility is fenced and is secured by a locking gate when it is not open for operation. 2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 3. The facility accepts waste Monday through Friday from 6:30 am until 4:00 pm. 4. The access roads are of all-weather construction and the storm water ponds were in stable condition and appeared to be functioning properly. 5. The facility permit, operations plan, waste screening logs, and training records were not reviewed during this inspection. 6. Leachate was observed ponding on the tipping floor due to improper drainage. Mr. Cotton stated that the leachate drains are serviced monthly and are free flowing. The pooling leachate was a result of the small diameter holes in the grate over the leachate drains. All drains should be clear and in free-flowing condition. The drains should be cleaned and maintained as necessary to ensure that they are functioning as designed. 7. Mr. Cotton stated that equipment maintenance is no longer performed on the tipping floor. Concrete barricades had been placed around the fuel storage tank to protect it from damage. However, an employee refrigerator and break area were still located in the western portion of the tipping floor. 8. Windblown waste was observed outside of the fencing to the north and east of the facility. Mr. Beliese stated that he would have one of the employees pick up the waste beyond the fence. Windblown waste was also observed within the catch basins and drainage ditch. Mr. Cotton stated that he had temporary workers pick up the waste twice a week. Windblown waste must be picked up and properly disposed of at the end of each operating day. Failure to do so may result in additional violations. 9. Several areas of hydraulic oil were observed near the transfer trailer staging area. Mr. Cotton stated that this was likely from the outside contractor who services the trailers. Mr. Cotton stated that he would have an employee scrape up the affected soils in these areas. 10. It is recommended that facility staff have access to the permit and operations plan for this facility. 11. Conducting site inspections per your approved operations plan may mitigate some of these issues. 12. Please ensure that all contact information in your operations plan is updated for this facility. 13. Corrective measures are necessary as a result of this inspection. 14.
