Recorded in Nash County Register of Deeds, Book 2631 — Page 302-304 PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. Date of Last Inspection: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS The Section has been informed that the property is in the process of being sold. It should be noted that the LCID notification cannot be transferred to the new owner. If the new owner wishes to operate a LCID, then the new owner will need to obtain a permit from the Section. The first approximately 1,900 feet of access road is a privately maintained dirt road with some large potholes. The remaining approximately 1,200 feet of access road is a vegetated farm road. It is recommended that the roadway be of all-weather construction and properly graded to allow for safe passage of the vehicles containing LCID waste. 2. The facility is not secured by a locking gate. No signage was posted at the facility. 3. The facility does not appear to have been used as it was overgrown with mature trees. Mr. Turnage stated that the LCID had not been utilized as a landfill. 4. Edge of waste markers had not been installed. EOW markers must be installed prior to accepting waste at the facility. 5. An access road must be established around the waste disposal area prior to the acceptance of waste at the facility. 6. During this inspection, tires and construction and demolition (C&D) waste had been dumped along the southern property boundary. The tires and C&D waste need to be removed from the property and properly disposed of at a permitted facility. Please keep copies of weigh tickets for the disposal of the unacceptable wastes. 7. Digital pictures were taken during the inspection. 8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. Please have the new owner contact the Section to schedule a follow-up inspection within 30 days to ensure issues noted in this inspection report have been addressed.
