Register of Deeds May 06, 2008 Current status of the Land Clearing and Inert Debris Landfill Notification is Inactive PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 2 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA OepaNnent W Environni.nbl puelily Solid Waste Section ADDITIONAL COMMENTS On March 3, 2023, Chuck Kirchner conducted a comprehensive inspection of the Pearman Quarry Road LCID Landfill on Pearman Quarry Road in Stokesdale, Guilford County. 1. The Pearman Quarry Road LCID Landfill is a notified land clearing and inert debris (LCID) landfill. 2. Operations of the landfill have ceased. 3. Landfill area has been covered with soil and a good grass cover has been established in most areas over the landfill. 4. The landfill appears to be less than 2 acres in size based the observations made during the inspection and a review of aerial imagery available online. 5. No water appears to be ponding on the landfill. 6. Continue to repair any eroded rills and seed and mulch any areas that may erode until a vigorous permanent grass cover sufficient to prevent erosion germinates in all disturbed areas around the landfill. 7. The facility has an all-weather access road. 8. The facility is secured by a locked gate. 9. Proper signage previously noted on site has been removed. 10. The edge of waste and property boundary must be marked and the distance between measured to demonstrate that there is at least a 100-foot buffer in place as required by 15A NCAC .0566(b). Any land clearing waste and inert debris that may be buried in the buffer area must be removed to another location in the landfill that meets this requirement and covered, or, delivered to a solid waste facility permitted to receive the land clearing waste. Mrs. Richardson previously stated that the facility does not plan to continue operations in the future and would like to close the facility. 11. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states "Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division." 15A NCAC 13B .0563 12. The Solid Waste Section will require something in writing stating the last time waste was received on site and the desire to close the site signed by the owner. 13. Once landfill is closed no additional material may be brought to the landfill unless another LCID permit is issued on site.
