Germanton, NC 27019 PARTICIPANTS: Jodi Buttry, Owner Robert Pike, Environmental Senior Specialist, Solid Waste Section STATUS OF PERMIT: Land Clearing and Inert Debris Landfill Notification application: October 13, 2006 Status of Land Clearing and Inert Debris Landfill Notification is OPEN. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The facility is a Notified LCID permitted to accept only yard waste and inert debris for disposal. During the inspection no unacceptable material was observed within the waste pile. 2. A sign containing the required information was posted at the facility entrance as required. 3. The site is secured by a locking gate. However, Jodi Buttry stated that the site access road also serves as the access road to a residence located east of the facility. Mrs. Buttry stated that the facility is secured by placing logs or machinery to block the access road up to the LCID. Mrs. Buttry discussed the use of chains to secure the LCID site access. 4. Facility access roadways are of all-weather construction and were in good condition. 5. The landfill side slopes were in good condition with established vegetative cover. The side slopes met the required three horizontal to one vertical slope. However, along the access roadway to the top of the landfill repairs were underway to repair the side slope from the heavy rain events over the past month. 6. Monthly cover was discussed, and Mrs. Buttly stated that the required cover was applied as needed or at the very least once a month as required. 7. The facility buffers were inspected and appeared to meet the requirements. 8. The facility appears to be under 2 acres in size as required. 9. Mrs. Buttly stated that the facility was in the process of applying for to become a permitted LCID facility as required by 15A NCAC 13B .0563(6).
