RESCOLVED: 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(a) states, “The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily.” During the previous inspection on December 21, 2022. Republic Services of North Carolina, LLC was found to be in violation of 15A NCAC 13B .0203(d) and Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(a) for allowing waste to be deposited outside of the tipping floor. During this inspection the loading bay area appeared to be maintained in a sanitary and clean condition. Mr. Bizzel stated that the equipment that was previously used to clean out the loading bay during the day was out of operation and has since been repaired. Resolved: 15A NCAC 13B .0405(a)(10) states, in part, “Windblown waste: Site staff shall conduct daily inspections for windblown waste on the site property. Windblown litter from site operations discovered during the daily inspections or observed on adjacent properties shall be picked up and containerized for disposal by the end of each operating day, unless the landowner of the adjacent property denies access to site staff.” During the inspection windblown waste appeared to be well managed throughout the facility. During the previous inspection Republic Services of North Carolina, LLC was found to be violation of 15A NCAC 13B .0405(a)(10) for failing to pick up and containerize windblown litter from the operation site. C. RESOLVED: 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(b) states in part “waste must only be deposited on a “tipping floor” or directly into a transfer container.” During the previous inspection on December 21, 2022, waste was observed deposited outside the loading bay area. During the inspection waste was observed only deposited on the tipping floor and directly into transfer trailers for transport, with no waste observed deposited outside the facility. OBSERVED VIOLATIONS: None. ADDITIONAL COMMENTS 1. The purpose of this inspection was to follow up on existing violations noted from the previous inspection. (See Status of Past Noted Violations section of this report for additional information.) 2. The facility loading bay was observed to be clean and in a sanitary condition. 3. The loading bay wall panel installation had been completed and the walls were in good condition with no damage to allow waste to escape the loading bay area. 4. The site was in good condition with little windblown waste observed. Mr. Bizzell stated that sweeping equipment had been brought in to help manage the wind-blown material. 5. Proper signage was observed on site. 6. Facility roadways are of all-weather construction. Damaged roadway areas had been filled with stone for a temporary solution. Catherine Hernandez stated that the repaving project for the facility was still scheduled for 2023. 7. The site is secured by a perimeter fence with locking gates to control site access. The main gate is still damaged, and Catherine Hernandez stated that the facility parks a transfer trailer at the entrance to prevent site access while the gate is waiting to be repaired. 8. No non-permitted material was observed on the tipping floor during the inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
