The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
The facility contains a closed Municipal Solid Waste (MSW) landfill with a closed separate Construction and Demolition (C&D) landfill area and an additional separate closed old MSW landfill area. The property also contains a disaster debris staging site (DS73-001) and a transfer station building that is no longer in use.
1. The facility ceased acceptance of MSW on April 8, 1994. The facility ceased acceptance of C&D waste on June 30, 1997. 2. The old MSW landfill area is located on the immediate left, upon entering the facility gate. The MSW landfill is straight back via the service road, and the C&D landfill area is on the right at the first curve in the
service road. 3. The landfill cap was covered in a good layer of native vegetation. Mr. Foushee stated that a local farmer mows and maintains the vegetation twice per year. 4. During this inspection, the horizontal pvc piping of the active LFG collection system on the western edge of the landfill was observed to be disconnected near the northernmost solar flare. Mr. Foushee and Mr. Cox
were able to reconnect the two sections of pipe, but further evaluation of this system may be needed to ensure it is functioning as designed. 5. 15A NCAC 13B .1627 (d)(1)(A), “…maintaining the integrity and effectiveness of any cap system, including making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion, or other events, and preventing rainwater that drains over land from or onto any part of the facility or unit from eroding or damaging the cap system.” During this inspection, water was observed ponding on the landfill in several areas within the edge of waste. Ponding was especially prevalent on the eastern edge of the landfill. Also, a small tree was observed growing on the southwestern slope of the MSW landfill. Within 30 days of receipt of this report or as dry weather conditions allow, ensure the settled areas of the landfill are repaired/regraded so that surface water does not impound over waste. Ensure any trees or woody vegetation is removed or rough cut to maintain the vegetative cover of the landfill and prevent damage to the landfill cap. Vegetation with a trunk or stem larger than 6 inches in diameter should be removed. 6. Edge of waste (EOW) were in place and visible from one to the next. 7. 15A NCAC 02C .0108 (l), “All non-water supply wells, including temporary wells, shall be secured with a locking well cap to ensure against unauthorized access and use”. During this inspection, the locks on two groundwater monitoring wells (MW-7, MW-7D) located on the east side of the MSW landfill adjacent to Mayo Creek had been cut and were non-functioning. In addition, the lock on a third groundwater monitoring well (MW-3), also located on the east side adjacent to Mayo Creek, was unlocked. Ensure all groundwater monitoring well and landfill gas monitoring well locks are periodically inspected for security, and any damaged or cut locks are replaced as needed.
