ADDITIONAL COMMENTS Permit to Operate, Attachment 1, Part IV (1)(b), βThe Permit to Operate shall expire at the close of business June 30, 2017. Pursuant to 15A NCAC 13B .0201(g), no later than March 1, 2017, the Permittee must submit a request to the North Carolina Department of Environment and Natural Resources, Division of Waste Management, Solid Waste Section, for permit review and must update pertinent facility plans including but not limited to the facility operation and waste screening plans.β
The Permit to Operate for this facility expired on June 30, 2017 and was not renewed. Please contact Sherri Stanley, Permitting Branch Head, at 919-707-8235 or sherri.stanley@ncdenr.gov for guidance.
1. The facility is a recycling center owned by Person County and operated by Person Industries. Person
Industries provides work experience for people with disabilities so they may obtain future employment. The facility Permit to Operate expired on June 30, 2017 and was never renewed. Facility Annual Reports are submitted every year and are up to date. 2. The recycling center is a materials recovery facility (MRF). Recyclables are dropped off at the facility by
county residents and businesses. Recyclables are generally hand sorted and baled.
3. Scrap tires are stored in two of four available semi-trailers located outside on the left side of the building. The facility is restricted to collecting and storing less than 2,000 scrap tires at any time in accordance with the Permit to Operate, Attachment 3, Part I, #3. 4. Scrap tires are loaded (laced) into trailers by county residents/businesses. A staff member provides direction
on proper scrap tire collection and loading procedure.
5. Ms. Gentry stated that scrap tires are not staged on the ground prior to being loaded into trailers, and the trailers are locked when the MRF is not in operation. 6. Scrap tire trailers are owned by the hauler, Emanuel Tire of Virginia, Inc, hauler identification number: NCT02445. The facility has ~ 4-5 trailers hauled off site per month. Each loaded trailer weighs ~ 10 tons.
Scrap tire information must be collected, and records maintained in accordance with the Permit to Operate, Attachment 3, Part I, #8 and the rules as required in .1107 (2)(k). 7. The scrap tires are hauled to scrap tire recycling operations. 8. North Carolina Scrap Tire Certification forms were verified for scrap tires received. Certification forms are kept in a large binder organized by date of drop-off.
9. Ensure a sign is posted at the entrance gate displaying the facility name, permit number (7306), and emergency contact information. 10. Changes to the Solid Waste Management Rules concerning scrap tire collection sites went into effect on December 1, 2018. All facility staff should be familiar with the rules for operating a tire collection site.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
