In accordance with North Carolina General Statute 130A-294 (a2) this permit is for life-of-site. Life-of-Site ends when the facility reaches its final permitted elevations or by June 24, 2057. PURPOSE OF SITE VISIT: Follow-up Comprehensive Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: A. 15A NCAC 13b .1626 (2)(b), “Except as provided in Sub-Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors.” UNRESOLVED: Exposed waste was observed in multiple areas throughout the landfill, including along the access road to the working face, along the side slopes, and at the toe of the north slope where the new cell (6B) is being excavated. This is an ongoing issue and needs to be addressed. Additional cover soil will need to be applied over areas of exposed waste prior to seeding and stabilization of these areas. OBSERVED VIOLATIONS: B. 15A NCAC 13B .1626 (8)(d), “Leachate shall be contained within a lined disposal cell or leachate collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to discharge.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 A large pile of soil was observed within the stormwater drainage ditch at the base of the western side slope. Mr. Harless stated the soil was put in place to absorb leachate which had drained down the side slope from a seep which was actively being repaired. Leachate cannot be allowed to drain beyond the edge of waste. Ensure impacted soils within the stormwater ditch are excavated, sampled for contaminants, and disposed of properly. Subsurface soils will also need to be evaluated as necessary. Please contact Perry Sugg, Environmental Compliance Branch Head, at perry.sugg@ncdenr.gov for guidance. ADDITIONAL COMMENTS 1. The facility accepts waste Monday through Friday 7:00am to 5:00pm and is now closed on weekends. The facility is fenced and secured by a locking gate when not open for operation and proper signage is posted at the entrance. 2. The permit, operations plan, and records were reviewed during this inspection and found to be up to date. 3. The facility has certified personnel on site during hours the site is open to the public. Certified personnel onsite are: a) William Harless, Certified Manager of Landfill Management, exp. 7/25/2024 b) Jeffrey Hawley, Certified Landfill Operations Specialist, LF-2007020, exp. 3/16/25 c) Michael Jackson, Certified Landfill Operations Specialist, LF-2013030, exp. 5/9/25 4. A new disposal cell (6B) on the north side of the landfill is currently being constructed and prepped to receive waste. Exposed waste was observed along the toe of the landfill slope where it meets 6B. Ensure these areas of exposed waste are covered with additional soil, regraded to ensure proper drainage, and vegetated. 5. Erosion rills are an ongoing issue and were present in multiple areas within the non-vegetated portions of the side slopes and along the access road to the working face. Erosion rills were also identified within some vegetated portions of the side slopes. Mr. Harless stated that he is constantly working on getting grass to grow in the non-vegetated areas but is unsuccessful due to the rocky makeup of the soil. Mr. Harless stated that there was mulch being generated from the power station project that could be used to aid in stabilizing the soil cover. Mr. Hammonds again recommended looking into local yard waste notification facilities as a potential source for mulch/compost supply to stabilize eroded areas and enhance vegetative growing conditions. The erosion rills need to be repaired, properly graded, and vegetated. Ensure that any exposed waste in the erosion rills is properly covered during the repairs. 6. The large sediment basin located near the southeastern corner of the landfill noted in the previous inspection had been dredged and Mr. Harless stated the smaller adjacent basin was also scheduled to be dredged. The stormwater drainage ditch along the base of the northeastern side slope was full of red clay mud and sediment. Stormwater drainage ditches should be cleaned out to ensure that they function properly. 7. During this inspection, high winds were prevalent, causing windblown waste to blow from the working face all over the landfill. Portable wind fence panels were in use on the top of the landfill but were largely ineffective due to the force and variability of the wind. Multiple facility staff were actively picking up windblown waste on the side slopes. Soil cover should be utilized as necessary to assist in reducing windblown. Ensure windblown waste is picked up by the end of the day. 8. Mr. Harless stated that the working face is covered by a tarp at the end of each weekday and covered with soil each Friday at the end of the day. 9. During this inspection, the water truck was in use and applying water to the access roads to suppress dust. Good job! 10. During this inspection, two leachate seeps were observed along the access road on the northeastern slope of the landfill within the edge of waste (EOW). Ensure any leachate seeps are repaired in a timely manner and monitored as needed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The leachate release should be stopped right away, and the cover and erosion issues corrected within 30 days receipt of this report.
