Fuqua, Solid Waste Director – Caswell County Solid Waste Department STATUS OF PERMIT: Yard waste notification facility renewal last submitted May 29, 2018. No form submitted for 2019. Yard waste facility notification expires on June 1st of each year. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 1. Status: Resolved - 15 NCAC 13B .1402(g)(1)(A) previously cited for a small Type 1 facilities not providing, “notification to the Division prior to operation and on an annual basis.” OBSERVED VIOLATIONS: None. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS On February 17, 2023, Chuck Kirchner met with A.J. Fuqua to conduct a comprehensive inspection of the Caswell County Yard Waste Notification site (YWN) on Landfill Road in Yanceyville, Caswell County. 1. The Caswell County Yard Waste Notification (YWN) facility is located at the closed municipal solid waste (MSW) landfill, number 17-01, adjacent to the scale house. 2. The area used for the YWN is less than two acres. 3. The facility does not compost material. The material accepted is ground for mulch. 4. The facility only accepts LCD material. 5. Temperature monitoring is required if high nitrogen to carbon ratio material (e.g. grass or leaves) are accepted prior to being re-distributed to the public. 6. No grass or leaf material was observed in the LCD material. 7. Material accepted is required to be less than 6,000 yd³ quarterly, processed and unprocessed combined. 8. Throughput records were verified for fiscal year 2018-2019. Facility Annual Renewal report showed 188 cubic yards processed on site from June 1, 2018 to May 31, 2019. Mulch is used on County property or given to the public or hauled away by the company grinding. 9. The material is stockpiled in a small windrow. 10. No ground material was on site during this inspection. 11. Mr. Fuqua stated that the material is typically ground every other year depending on quantity in the YWN. 12. Facility shall ensure Fire Department can access entire YWN stockpile both processed and unprocessed in the event of a fire. 13. The facility will call the Yanceyville Fire Department in case of emergency. 14. Notify the Solid Waste Section verbally within 24 hours and submit written notification within 15 days of any fire as discussed in the field. The facility is secured by a locked gate. 17. The facility has proper signage. 18. The YWN facility renewal form shall be submitted to the SWS annually, by June 1st. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
