The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On February 16, 2023 Chuck Kirchner conducted a comprehensive inspection of the Foushee Grading LLC LCID Landfill on Moncure Pittsboro Road in Moncure, Chatham County.
1. The Foushee Grading LLC LCID Landfill is a notified land clearing and inert debris (LCID) landfill.
2. The LCID landfill is < 2 acres.
3. The landfill boundary is required to be designated. EOW is designated by white PVC [vertical] pipe. Ensure boundary markers are maintained as needed.
4. The LCID landfill is not open to the general public. Foushee Grading LLC personnel access the site.
5. A complaint was received on site for mobile homes being demolished at the LCID landfill. No evidence of mobile home demolition was observed on site. In addition, no C&D waste was observed
in the LCID landfill.
6. The LCID landfill has good ground cover.
7. A small amount of LCID material and concrete material is staged on top of the landfill.

8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.”
9. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area
reaches one acre in size, whichever occurs first.”

10. Clean concrete is also staged on top of the landfill near the working face.

11. Thirteen pieces of concrete were observed to have paint on them in the concrete stockpile next to the
LCID landfill. Painted concrete and brick cannot be recycled. Any painted brick or concrete shall be removed from the stockpile and disposed of in a permitted C&D or MSW landfill.

12. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of
erosion or runoff is observed.
13. There was no indication of erosion or runoff.
14. Northward of the landfill is a soil borrow pit/soil storage area.
15. The facility has two sediment basins on the eastside of the disposal area.
16. The facility has an all-weather access road.
17. The facility is secured by a mechanical/electronic gate.
18. The entrance drive to the facility is at [mailbox] 4900 Moncure Pittsboro Road.
19. The facility has a sign. 20. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states “Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this
Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and
was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division.” 15A NCAC 13B .0563
