PURPOSE OF SITE VISIT:

OBSERVED VIOLATIONS: NA
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell, with the Section, followed up on corrective actions at the YWN. Temporary Disaster Debris
Site, TDDS, DS78-035, next to notification. Moving part of the YWN into and crossing part of TDDS was discussed. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
3. Site was gated but gate was open. Mr. Powell spoke with onsite staff and then contacted Mr. Ashburn, who stated Mr. Derrick Edge would be handling this site and would be onsite in few moments. Once Mr. Edge arrived, Mr. Powell and Mr. Edge walked part of the notification and discussed what has been done and what corrective actions that are still needed onsite. Some unapproved wastes were visible in mulched windrows and newer YW.
15A NCAC 13B .1402 (e) - Solid waste compost facilities shall be classified based on the types and amounts of materials to be composted as follows: (1) Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste.

4. Yard Waste, YW, has been mulched and windrowed, but it has been moved from original notification area into open area that’s also a TDDS, inside the loop access road near rear of the open part and located inside part of the TDDS. Another windrow was upfront near access road. So, the YW has been spread out into three areas with two being side with the TDDS. Waste was supposed to be removed due to it being here several years. All waste inside the TDDS should be removed to appropriate disposal site immediately. Documentation should be kept and provided to David Powell/Section. Robeson County was discussed for disposing at their
LCID or using for 50/50 ADC soil and mulch mixture onsite if County so desired. Later, Mr. Powell emailed YWN and TDDS rules, 2022 YWN renewal, TDDS documents for DS78-035 and wetland map. Mr. Powell also emailed a suggestion to contact Sampson County Landfill to see if they would like to take the YW for 50/50 ADC mix as well.

5. Wetland area has had most waste removed, however there is some yard waste and trash needing removal. Please remove the waste to appropriate disposal site, keep documentation. Please do not dig in wetland. As stated in previous inspection, “Division of Water Resources / Army Corp of Engineers (ACOE) may have additional requirements with the wetlands other than just removal of all waste. Town of Red Springs should contact Division of Water Resources (DWR) Chad Turlington, chad.turlington@ncdenr.gov or 910-433-3320, quickly, to be consulted on these requirements before any
action begins. Document any waste removal and its disposal. Mr. Edge did have wetland area marked, with a 50 ft buffer, utilizing T posts. A yellow tape was also used to mark the area. Please finish cleaning up the wetland area, and finish marking the area with the 50-foot buffer and be sure nothing is disposed in this area. This is not considered “delineation” but just markers for keeping any waste, fill or to prevent any other activity inside the wetland that may violate any wetland rules.

YW and trash inside wetland area. 6. YWN still needs Edge of Waste (EOW) markers to finish marking the other corners of what will be used for the notification. The notification needs to be buffered 50 ft from any property line. Any storm related waste, once site is activated during an emergency, will need to be separated from weekly YW collection.
7. DS78-035 - In the event of a disaster, as with any Temporary Disaster Debris Site (TDDS), and you call or email to activate the debris site, be sure to the disaster debris separate from YW material. Be sure to always keep YW material inside of the approved 2 acre or less area always. 8. Before sending this inspection report, Mr. Powell contacted Town Red Springs and spoke with Town Manager Mr. Ashburn and discussed corrective actions. Mr. Ashburn indicated they were finalizing taking bids for
removal of the waste inside the TDDS. Also, that the Town was confident that within a month all the waste would be removed. Mr. Powell asked about future management for YWN, and Mr. Ashburn indicated in the future, the YWN would have waste hauled annually for disposal. Mr. Ashburn noted the wetland area had trash and YW removed at this time. Mr. Powell discussed with Mr. Ashburn the 2022 renewal stating, “The finished mulch will be hauled off to a local sand pit or giving to farmers. The Town will some of the mulch as natural organic fertilizer around town flower beds.” Mr. Powell explained the waste from the notification had Yard
trash comingled and must meet 15A NCAC 13B .1406 before it can go to the public. Mr. Powell also explained waste remaining for multiple years violates General Statue § 130A-309.05. Regulated wastes; certain exclusions, which indicates 75% of what is collected must be utilized/removed within a calendar year of its acceptance. Other options for YW collection and disposal were discussed. The Town may benefit from just collecting and hauling waste to a permitted disposal site for this waste type and not collect, store, manage, mulch, then pay for hauling and disposal too. The annual renewal should be altered to reflect the true onsite operations and met rule.

9. Corrective measures are necessary as result of this inspection and should be completed within 30 days. A follow up compliance inspection will be conducted by Solid Waste Section Staff within about 30 days, or shortly after, receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions. If further time is needed, then David Powell with the Section should be contacted and a request made in writing via email.
