OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No7908-COMPOS-2018, ATTACHAMNET 3, PART 1, General Facility #5 states, in part “open burning of solid waste is prohibited.”
B. 15A NCAC 13B .1406 states: “A person who maintains or operates a solid waste compost facility shall maintain and operate the site to conform with the practices and operational requirements of this rule.” 15A NCAC 13B .1406(7)(a) states, “open burning of solid waste shall be prohibited.”

During the inspection an air curtain incinerator was observed to be on site. Ash material was observed to be scattered on the ground surrounding the incinerator and a pile of smoldering land clearing debris was located north of the incinerator. Mr. Shelton stated that the facility had used the incinerator Monday through Friday during the previous two weeks. The City of Reidsville is in violation of 15A NCAC 13B .0203(d) and 15A NCAC 13B .1406(7)(a) for conducting open burning at a permitted solid waste compost facility. To achieve compliance, the City of Reidsville must properly dispose of all ash at the site as well as all wood waste that was smoldering on the day of the inspection once safe to do so and when the fire is completely extinguished. Provide proof of disposal to Robert Pike at robert.pike@ncdenr.gov. A follow-up inspection will be conducted.
ADDITIONAL COMMENTS 1. The site contains a large Type 1 compost facility that is permitted to accept land clearing debris and clean, untreated wood waste. The compost created onsite is offered to Reidsville City residents. 2. The facility also serves as a pre-approved temporary debris storage and reduction (TDSR) site. 15A NCAC 13B(b)(9) requires that “The site operator shall notify the Division verbally or in writing that the site is accepting
waste within 14 days of initial acceptance of waste after a disaster event” Please notify the Solid Waste Section before opening the TDSR for use as required. 3. The site is secured by fencing and an electronic gate. The facility is only open to the public on specific days when
compost is being distributed. During these times city staff is onsite to help and direct the public. 4. Proper signage was observed at the entry gate. 5. The facility roadways are of all-weather construction and in good condition.
6. During the inspection an air-curtain incinerator was on site located next to the wood waste stockpile. The incinerator had been used to burn wood waste that had been stockpiled on-site. Mr. Shelton stated that the incinerated material was removed from the incinerator and transported to the Rockingham County landfill for disposal. Please see the Observed Violations section of this report. 7. No ponding water was observed on site around the unprocessed wood waste.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
