Terms of Permit 1. The customer must follow the City's Rules for Septage Haulers. These rules define the requirements for discharging wastewater into the WWTP. 2. Only the wastewater described in Part I, D is allowed. A sample may be collected from each load and submitted to the laboratory for analyses. Should discharge and/or results indicate a problem, the septage hauler will be contacted immediately and not allowed to discharge again until issue is resolved. 3. All wastewater shall meet the Sewer Use Ordinance restrictions for pH, flammability, metals, toxic and hazardous wastes, or any other restrictions that may be included. 4. The monthly fee for disposal shall be identified in the Septage Hauler Rates information. Each time wastewater is to be discharged, a City form shall be completed by the driver of the vehicle PRIOR to discharge that identifies the type of wastewater to be discharged, volume discharged, and the address and phone number of the location that the wastewater was generated. The original form will remain at the WWTP; the driver shall remove the carbon copy of the form for his records. 5. Discharge shall occur during the hours of 7:30 am to 5:00 pm, Monday through Friday. Discharge may occur after hours and on holidays for an additional charge. In an emergency, please contact City personnel for instructions. At the discharge site, the driver of the vehicle is to ensure that the area is kept clean and free of debris. If there is a problem during discharge, or a spill the driver shall halt discharge and immediately contact facility personnel. Failure to do either of these may result in revocation of dumping privileges. Should the Terms of Permit be violated, penalties will be imposed which may include fines and/or loss of dumping privileges. C. Any permit noncompliance constitutes a violation of the City's SUO and may constitute a violation of state and/or federal regulations. Therefore, any permit noncompliance is grounds for possible enforcement action. 2. Duty to Mitigate - Prevention of Adverse Impact The permittee shall take all reasonable steps to minimize or prevent any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health, the POTW, the waters receiving the POTW's discharge, or the environment. 3. Availability of Records and Reports The permittee shall retain records of collection of all wastewater to be discharged to the City's WWTP. All records that pertain to matters that are subject to any type of enforcement action shall be retained and preserved by the permittee until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired. Except for data determined to be confidential under the City's SUO and state and federal pretreatment regulations, all reports prepared in accordance with terms of this permit shall be available for public inspection at the City. 4. Duty to Provide Information The permittee shall furnish to the Director of Water Resources or his/her designees, within a reasonable time, any information which the Director, his/her designee may request to determine whether cause exists for modifying, revoking and reissuing, or terminating this permit or to determine compliance with this permit. The permittee shall also furnish, upon request, copies of records required to be kept by this permit. 5. Civil and Criminal Liability Nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance. 6. Federal and/or State Laws Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any applicable federal and/or state law or regulation. 7. Penalties The SUO of the City and state law (NCGS 143-215.6A) provides that any person who violates a permit condition is subject to a civil penalty not to exceed $25,000 dollars per day of such violation. Under state law (NCGS 143-215.613), under certain circumstances it is a crime to violate terms, conditions, or requirements of permits. It is a crime to knowingly make any false statement, representation, or certification in any record or other document submitted or required to be maintained under this permit, including monitoring reports or reports of compliance or noncompliance. These crimes are enforced at the prosecutorial discretion of the local District Attorney. 8. Transferability This permit shall not be reassigned or transferred or sold to a new owner, new user, different premises, or a new or changed operation without approval of the City. 9. Modification, Revocation, Termination This permit may be modified, revoked, and reissued or terminated with cause in accordance to the requirements of the City's SUO. 10. Re -Application for Permit Renewal The pennittee is responsible for filing an application for reissuance of this permit at least 30 days prior to its expiration date. Wastewater identified on the Septage Hauler Permit is the ONLY wastewater the Hauler shall discharge to the City of Rocky Mount's Regional Wastewater Treatment Facility. NO wastewater from any commercial or industrial facility is to be discharged without prior permission from the Wastewater Treatment Plant Superintendent. 2. Disposal of any wastewater through the City of Rocky Mount's wastewater treatment facility shall be under the control of the Wastewater Treatment Superintendent and with prior permission from the Director as identified on the Waste Hauler's Permit. 3. All wastewater shall meet the Sewer Use Ordinance restrictions for pH, flammability, metals, toxic and hazardous wastes, Oil and Grease, or any other restrictions that may be included. Should these restrictions be violated, penalties will be imposed which may include fines and/or loss of dumping privileges. 4. A disposal station will be maintained at the Regional Wastewater Treatment Facility (3031 Treatment Plant Road). Disposal of wastewater through the Regional Wastewater Treatment Facility by dumping at any other point will not be permitted unless otherwise approved by City of Rocky Mount. 5. Discharge shall occur during the hours of 7:30am and 5:00pm Monday through Friday. Discharge may occur after hours and on holidays for an additional charge. In an emergency, please contact City personnel for instructions. City Operations personnel must be present to discharge material into City's treatment system. At the discharge site, the driver of the vehicle is to ensure that the area is kept clean and free of debris. If there is a problem during discharge, the driver shall halt discharge and immediately contact facility personnel. Failure to do either of these may result in revocation of dumping privileges. 6. Should the City of Rocky Mount's Regional Wastewater Treatment Facility experience any operational/treatment problems during the course of approved discharge, the Waste Hauler will be notified, and discharge will cease immediately. 7. At the time of check -in, haulers will be required to manifest the originating location of the septage identifying by name, address, and phone number. 8. Nonpayment of due bills within required period will result in the addition of a late payment penalty by Utility Billing and may result in loss of dumping privileges.
