Parkton, NC 28371 PARTICIPANTS: Dwayne Parker, Parker and Sons Chris Parker Jason Watkins, SWS STATUS OF PERMIT: N1027 – Notification originally 2009 PURPOSE OF SITE VISIT: Partial Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: Previously noted violations of 15A NCAC 13B .0566 (2 &3) have been fully resolved OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The purpose of this visit was to follow up on the completion of corrective actions noted from the July 12, 2022 inspection and the on-site meeting on September 27, 2022, between representatives of Parker & Sons and the Solid Waste Section. 2. On November 15, the Section was provided with a recombination plat filed with the Robeson County Register of Deeds (Map Book 60, Page 200) showing a property exchange to provide the minimum 100-ft buffer around the landfill. Additionally, the recorded plat showed the landfill to be 1.95 acres in size. 3. A plan of action was also submitted for work to be completed by the end of December 2022 to address other on- site corrective actions. These actions included removal of waste from an area to the northeast of the landfill and disposal in the landfill footprint, re-establishment of the permanent edge of waste markers per the new plat, and regrading of the landfill side slopes. 4. Based on observations during the inspection, all the items in #3 above and the previous inspection reports have now been completed and are fully resolved. 5. As noted in item #2 above and the revised survey plat, there is a .05 acre sliver in the NE corner of the landfill that remains available to fill as well as continued vertical expansion on top of the existing area. As discussed on site, permanent groundcover in the form of a grass species that can be mowed and/or otherwise maintained should be established on all remaining 3 sides of the landfill below the current fill line, and subsequently once the .05 acre area has been brought up to current landfill elevation. 6. As has been previously conveyed, the current notified LCID landfill must cease operating no later than January 1, 2026 or be covered by a solid waste permit due to changes in the applicable rules effective January 2021. Closure of the landfill must be completed in accordance with 15A NCAC 13B .0567(1). Should the facility choose to expand the horizontal footprint of the landfill as was discussed on-site, a full permit application should be submitted to the Section no later than January 2025 to allow processing prior to the rule required closure date.
