Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. LF had a recapping project in 2018 with some issues. Access limited by gate. Dereck Harris, Bladen County, rode Mr. Powell around the perimeter of the Closed MSW to follow up on mowing and removal of shrubs and trees along limits of disposal. Facility has many EOW markers in place and Bladen County staff has removed some shrubs and trees, which allowed for additional EOW markers to be visible which shows that there is additional vegetation needing removal. It isn’t apparent what the limits of the Closed MSW are onsite based on EOW markers. Review of historical documents also don’t answer this question definitively. There was a DOT project which caused some waste to be removed and placed in a different location and extra soil staged onsite to change slope. A screenshot image of a Google Maps image below depicts the Closed MSW. The Closed MSW is understood to be mostly in the eastern open area all the way to NC 87, surrounded by trees. However, there is an open area, also surrounded by trees and just south of the access road, closer to US 70 which also has EOW markers inside tree line. This area is just in front of the old Transfer Station building that’s overgrown. Bladen County needs to evaluate their records/landfill and determine the actual limits of the Closed MSW and mark them appropriately. The County needs to submit a determination or justification, with supporting documentation, to the Section to review, and the Section will follow up once EOW is marked properly and determine what, if any, additional corrective actions may be needed at that time. Facility has been mowed and with some of shrubs and trees removed, its apparent, either the true EOW isn’t marked well or there are EOW markers missing. Please fix, stated in previous section. Access roadway is to right, out of view, and old Transfer Station in view on right. EOW marker also visible. EOW markers inside tree line all around this open area with some missing. 3. Corrective actions are necessary as result of this inspection. Bladen County needs to evaluate their records/landfill and determine the actual limits of the Closed MSW and mark them appropriately. The County needs to submit a determination or justification, with supporting documentation, to the Section to review, and the Section will follow up once EOW is marked properly and determine what, if any, additional corrective actions may be needed at that time. These actions should be completed within 30 days from the date of this inspection report sent. A follow up inspection will be conducted at that time or shortly after. Failure to resolve these matters may result in further enforcement action.
