Life-of-Site PTO issued August 15, 2018; expires May 1, 2074. PURPOSE OF SITE VISIT: Follow-up Partial Compliance Inspection for NOV Resolution STATUS OF PAST NOTED VIOLATIONS: A. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” Permit to Operate, Attachment 3, Part VI (24), “All water or liquid that comes in contact with solid waste, including vehicle wash-down water is leachate and must be captured and properly treated before release into the environment.” RESOLVED: A sampling plan and supporting documentation was submitted to and approved by the Section, affected soils were removed, and subsurface soils were satisfactorily sampled and analyzed. Elizabeth Werner, Section Hydrogeologist, approved the sample results in a letter dated 1/12/2023, stating no further action is

required. A concrete curb has been installed as a permanent leachate containment measure along the edge of the transfer trailer loading bay access road. OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” RESOLVED: Gaps along the base of the maintenance shelter have been sealed with Lexel Elastic Sealant and chemical absorbent socks are also being used to contain liquids within the shelter. The above-ground storage tank
has been moved inside the maintenance shelter. A sampling plan and supporting documentation was submitted by to and approved by the Section, affected soils were removed, and subsurface soils were satisfactorily sampled and analyzed. Elizabeth Werner, Section Hydrogeologist, approved the sample results in a letter dated 1/12/2023, noting that location NP-2 needed further remediation. Additional NP-2 sample results were still pending at the time of this inspection.
ADDITIONAL COMMENTS
1. Embankments have been installed in the transfer trailer staging area to provide a slope and help eliminate leaks
from loaded trailers. During this inspection, a loaded transfer trailer was observed actively leaking within the staging area. Upon closer inspection, a garden hose was found to be wedged within the rear door, preventing a proper seal. Mr. Apple immediately notified facility staff and a containment trough was placed under the leak. Continue to ensure loaded transfer trailers are inspected for proper seals and/or leaks and any deficiencies are repaired as needed. Any soils or gravel impacted by leaking trailers should be removed as soon as they are observed and disposed of properly. 2. Permanent concrete curbing has been installed along the transfer trailer loading bay access road and appeared to be functioning as intended and preventing leachate from contacting the adjacent soil. However, a large standing pool of leachate was observed on the access road pavement and within the loading bay, indicating that the leachate drains within the loading bay were obstructed. Ensure all leachate drains are cleaned as needed to facilitate proper drainage. 3. During this inspection, the drains along the push wall adjacent to the tipping pad were clogged with waste. Leachate was observed pooling up on the tipping pad. The drains should be cleared and maintained as necessary so that they are functioning properly.
4. Multiple areas of the concrete apron leading up to the tipping floor are damaged/cracked and retaining leachate. It is recommended that these areas of the apron be repaired to eliminate potential migration of leachate onto the adjacent gravel driveway area and subsurface soils.
5. During this inspection, waste, some overhung with cobwebs, was observed behind the push wall on the western side of the transfer station building, indicating the waste has been there for some time. Ensure all waste is removed from behind the push walls at the end of each day of operation in accordance with 15A NCAC 13B .0405 (a)(11). 6. Windblown waste continues to be properly managed and active cleanup was occurring during this inspection. The facility grounds were clean and primarily free from windblown waste. Good job! 7. Stained soils adjacent to the concrete pad adjacent to the maintenance shelter observed during the previous inspections had been removed. Mr. Apple stated that transfer trailers were no longer parked on this concrete pad, which is now used only for maintenance purposes.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
