July 27, 2022 Ms. Sandra Bramble, RPM Superfund Restoration and Site Evaluation Section Superfund Division US EPA Region IV Waste Division 61 Forsyth Street SW, 11th Floor, Atlanta, GA 30303 Subject: Preliminary Assessment (PA) Report DAFCO Totes Site (a.k.a., Anderson Properties) EPA ID: NCS000002196 Hudson, Caldwell County, NC Dear Ms. Bramble, Under authority of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) and the Superfund Amendments and Reauthorization Act of 1986 (SARA), the NC DEQ Superfund Section conducted a Preliminary Assessment (PA) at the above site. The purpose of this investigation was to collect information concerning conditions at the site sufficient to determine the need for additional CERCLA/SARA or other appropriate evaluation. Based on the results of this investigation, this site is recommended for No Further Remedial Action Planned (NFRAP) designation under CERCLA. The scope of this investigation included reviews of NC DEQ Hazardous Waste Section (HWS) inspection and enforcement documents from 2018 and 2019 and a 2020 removal action conducted by a private contractor for a potentially responsible party (PRP). NC and Avery County geographic information system (GIS) data were reviewed to identify potential groundwater receptors near the site. Field investigation included passive soil gas (PSG) sampling, due to historical storage and use of chlorinated volatile organic compounds (cVOCs) at the site property. Site Description, Operational and Regulatory History and Waste Characteristics: Site Description: The site is a commercial/industrial property located at 2698 Hickory Boulevard, Hudson, NC 28638. Geographic coordinates at the central part of the on-site storage area are 35.86228o N Latitude and 81.48553o West Longitude (Refs. 3, 4, 5, 6; Figs. 1, 2A). Ms. Bramble July 27, 2022 Page 2 The site property is a 5.42-acre parcel which forms the rear (eastern) portion of a larger, approximately 25-acre property that constitutes the facility. The smaller parcel contains a former truck maintenance building, and the facility parcel to the west contains a 65,000 square-foot aluminum structure with garage bays and loading docks. The 25-acre property is bordered by residential/undeveloped properties to the north and southeast, by a church property to the east, by commercial property to the southwest and by Hickory Boulevard/Highway 321 to the west (Refs. 4, 5, 6; Fig. 2A). The 25-acre site property’s original land surface elevation (mean sea level) ranged from approximately 1180 feet at Hickory Boulevard to 1260 feet at the site’s north property line. Facility construction apparently included excavation and re-grading within a pre-existing natural drainage, and most of the site property now lies near-level at approximately 20 feet lower than surrounding properties to the east, north and west. The site reportedly has a stormwater conveyance system. Two intermittent surface drainage features exist on site, the main one running along the south property line and the secondary one following the base of the cut slope at the northwest edge of the facility. The two drainages combine to the southwest, and runoff is conveyed via culvert to a pond on the southwest side of Hickory Boulevard. (Refs. 7, 8, 9). Site Operational and Regulatory History and Waste Characteristics: Tax records indicate that the site property was developed as a distribution warehouse during (or prior to) 1972 (Ref. 7). The current site owner leased the site to a trucking company from 1995 until 2009, and part of the site was in similar use in 2020 (Refs. 6, 7). In 2015, the owners leased the western 5-acre parcel to DAFCO, a North Carolina corporation. DAFCO fabricated wastewater treatment systems and treated and cleaned wastewater totes for reuse. Tailored Chemical Products, Inc. (TCP) paid DAFCO to clean wastewater totes that were delivered to the site. DAFCO had previously operated at a leased property in nearby Lenoir, NC. However, after DAFCPO failed to pay rent the other property owner transported approximately 9000 totes to the current site location during 2015 and 2016. Each tote contained approximately 275 gallons of untreated wastewater. In 2016, DAFCO sold its assets to Eco-Tote Container Services, LLC (Eco-Tote), which briefly took over DAFCO’s operations before abandoning the site and totes. Both entities subsequently were administratively dissolved (Refs. 4, 5, 6). DAFCO TotesNCS000002196 Preliminary Assessment Ms. Bramble July 27, 2022 Page 3 On May 11, 2018, the NC DEQ HWS conducted an on-site inspection in accordance with the federal Resource Conservation and Recovery Act (RCRA). The compliance inspection was conducted one day after the Hudson, NC Fire Chief contacted the EPA Region 4 National Response Center (NRC), reporting that several of the wastewater totes left on the site appeared to be leaking (Ref. 4). Also present during the inspection were personnel from the Town of Hudson, Hudson Police and Fire departments, Caldwell County Emergency Management, a former DAFCO representative, a US EPA On-Scene Coordinator (OSC), and a representative of the site owner (Ref. 4). The contents of the totes reportedly appeared to be wastewater generated from manufacture of white glue. In 2015, Tailored Chemical Products had demonstrated through generator knowledge that the glue and wastewater were not hazardous waste. In addition, approximately twenty-five 55-gallon plastic containers and a 25-gallon steel container were observed on site. Some of the 55-gallon containers were labeled as containing corrosive materials, and the steel container was labeled as containing nitric acid. In a subsequent site visit on May 24, 2018, approximately half of the 55-gallon containers and at least one tote were determined to contain hazardous waste (D002) corrosive liquids, and the nitric acid tank contained a small hole. The containers were segregated and assessed for leaks and NC HWS personnel requested that the nitric acid container be overpacked (Refs. 4, 5). On May 31, 2018, the HWS issued an Immediate Action Notice of Violation (IANOV) to the site owner for RCRA violations in 1) failing to make proper hazardous waste determination and 2) storing hazardous waste without obtaining a hazardous waste management permit. The 55- gallon containers were subsequently removed from the site in accordance with the IANOV (Refs 4, 5). On August 2, 2018, the NC Solid Waste Section (SWS) issued SWS NOVs to the site owner and to Tailored Chemical, requiring an assessment and inventory of the totes and specifying that a plan of action would need to be approved before removal. On September 6, 2018, Tailored Chemical submitted an initial assessment plan, which the SWS determined did not fully address the requirements of the NOV (Ref. 5). On January 24, 2019, the SWS received analytical data from a composite sample of glue and wastewater collected by Tailored Chemical from approximately 20 totes at the site. Analysis for RCRA characteristic constituents identified tetrachloroethene (PCE: 2.07 mg/L) exceeding the RCRA regulatory level (0.7 mg/L) and characterizing the material as (D039 - PCE) characteristic hazardous waste. The SWS notified the owner and Tailored Chemical that a hazardous waste characterization and sampling plan would need to be submitted and approved prior to any additional characterization at the site. The SWS also notified that the containers on site would need to be labeled as hazardous waste and transported to a RCRA-permitted treatment, storage and disposal facility within 90 days, and that the site would need to obtain an EPA identification number and comply with large quantity generator regulations prior to further assessment (Ref. 5). DAFCO Totes NCS000002196Preliminary Assessment Ms. Bramble July 27, 2022 Page 4 On February 19, 2019, the HWS issued an Immediate Action Notice of Violation (IANOV) to Tailored Chemical for RCRA violations in 1) failing to make proper hazardous waste determination and 2) storing hazardous waste without obtaining a hazardous waste management permit. Sampling plan letters submitted in response by Tailored Chemical attorneys on March 13 and (revised) on April 2, 2019 were determined to be inadequate (Ref. 5). In early April 2019, the US EPA met with parties involved with the site to request that the responsible parties (PRPs) conduct an emergency response stabilization, due to the ongoing deterioration of the totes from exposure to the elements, and their proximity to residential areas and surface drainage. The PRPs agreed and their environmental contractor initiated the action on April 6, 2019. During an unannounced Compliance Development Inspection on June 17, 2019, HWS personnel observed that liquid wastes were being placed into frac tanks and solidified sludges were being composited into a roll-off container. Waste materials were being evaluated for PCE via Toxicity Characteristic Leaching Procedure (TCLP) (Ref.5). On April 21, 2020, Tailored Chemical submitted their final report on the emergency response. Hazardous tote liquids had been transported to the following permitted disposal facilities: Dart, Charlotte NC; EQ Detroit, Detroit MI; Giant Resource Recovery, Harleyville and Sumter, SC. Hazardous solidified tote waste had been transported to the latter three facilities and to Michigan Disposal Waste Treatment, Belleville MI. Based on photoionization detection (PID) readings, liquids from ninety totes were segregated, determined (by laboratory analysis) to be non- hazardous, and transported to Shamrock Environmental, Browns Summit NC. Throughout daily response activities, contractors had monitored wind speed and direction and air temperature and monitored air quality at the upwind and downwind property lines by PID. Contractor, EPA and NCDEQ personnel completed a final meeting and site walkover on February 18, 2020 (Ref. 6). During the April 2019 site visit, HWS personnel noted that attempts were being made to identify use of private domestic wells near the site. However, no results from this effort were documented in the Tailored Chemical final report, or in the March 2022 (Final) HWS RCRA Inspection Reports (Refs. 5; 6). Groundwater Migration Pathway and Targets: Caldwell County, NC lies within the Piedmont Physiographic Province. The piedmont landscape is characterized by rolling surface topography with well-rounded hills and northeast- southwest-oriented ridges, dendritic surface drainage patterns and broad, flat inter-stream areas (Ref. 10; Fig 1). Surface soil over the developed portion of the site is mapped as Urban Land Complex, 0- 15% slopes (Ref. 11). This description is consistent with the extensive excavation/grading that apparently occurred during original construction of the existing on-site facility (see Site Description). DAFCO TotesNCS000002196 Preliminary Assessment Ms. Bramble July 27, 2022 Page 5 The site is located within the Inner Piedmont Belt geologic region of the state. Bedrock in and around the site is mapped as late Proterozoic to Cambrian age sillimanite mica schist (Ref. 12). Average annual precipitation in the area is approximately 48 inches (Ref. 13). Precipitation that does not run off to streams infiltrates the ground surface. Infiltrating water that is not lost to evapotranspiration migrates down through the soil column to recharge the underlying aquifer. In the piedmont, the groundwater aquifer consists of fractured bedrock and an overlying veneer of saprolite (weathered rock). Groundwater seeps through the permeable saprolite, but migration through competent bedrock occurs primarily via discontinuities including fractures, faults and bedding planes. Groundwater within the saprolite migrates laterally and vertically to points of discharge on lower hillslopes and at streams in valleys. Groundwater also enters open bedrock fractures and typically migrates into nearby valleys by this route (Ref. 10). Based on surface topography and drainage, groundwater beneath the site is anticipated to move in a southwesterly direction. However, wells operating in proximity to the site in other directions could potentially draw groundwater from beneath the site through open bedrock fractures. The site property and properties to the north, east and immediate southwest are located within the incorporated Town of Hudson, NC. (Ref. 7) The city of Lenoir supplies drinking water to residences and businesses within incorporated Lenoir and Hudson (Ref. 14). The municipal water source is a surface-water intake located on Lake Rhodhiss, approximately 9 miles south of Hudson. The nearest community water supply well is located 3.72 miles north of the site (Ref. 9; Fig. 1). GIS-mapped water lines supply the (incorporated) residential neighborhood to the north of the site (Ref. 7). Residences on Family Tree Lane and Maple Lynn Place, northwest and southeast of the site, either have listed municipal water accounts or reportedly share with other residences that do so. On Coy Hartley Lane, southwest across Hickory Boulevard from the site, two of three (separately owned, adjacent) residences have water accounts; the third resident did not respond to a written query by the NC Superfund Section, but is anticipated to share with a neighbor (Refs. 15, 16). Residences and businesses farther outside city limits that are not connected to public water line extensions are anticipated to rely on private wells for drinking water. Based on the absence of proximal groundwater targets, the exposure hazard posed by the site via the groundwater migration pathway appears to be minimal. DAFCO TotesNCS000002196 Preliminary Assessment Ms. Bramble July 27, 2022 Page 6 Surface Water Migration Pathway and Targets: Two minor surface drainage features bracket the developed portion of the site property to the northwest and south. To the southwest, just beyond Hudson Boulevard, lies a small pond which is the probable point of entry (PPE) to the 15-mile surface water pathway. The pond drains to Angley Creek, which then flows southeast 1.5 miles before joining Gunpowder Creek. Gunpowder Creek flows approximately 7 miles southeast into the Lake Hickory Reservoir portion of the Catawba River, which constitutes the remainder of the 15-mile surface water migration pathway target distance limit (TDL)(Refs. 8, 9; Fig. 1). The City of Hickory NC operates a municipal surface-water intake on the upper portion of Lake Hickory Reservoir, upriver from the confluence with Gunpowder Creek. No public surface- water intakes reportedly operate farther downstream, within the 15-mile TDL (Ref. 9). The small pond downgradient from the site (southwest of Hickory Boulevard) is accessible via a private road, but aerial photography indicates otherwise-limited accessibility and development (Ref. 3). The much larger Lake Hickory Reservoir is identified as a fishery with multiple access points, and is therefore much more likely to be routinely fished for human consumption (Ref. 17). The nearest downstream wetland is a 0.14-mile frontage located approximately 0.3 mile below the PPE. Wetland mapping indicates that Angley Creek and Gunpowder Creek contain a total of 1.1.mile of wetland frontage, most of which lies farther downstream near Hickory Lake Reservoir (Ref. 8). Based on the above information, the exposure hazard posed by the site via the surface water migration pathway appears to be minimal. Soil Exposure and Subsurface Intrusion and Air Migration Pathways and Targets: The site is an active/semi-active commercial trucking facility. A limited number of people were working locally on site during the initial May 2022 PA site visit, but no workers were present when sampling activities concluded 11 days later. The site perimeter is not visibly fenced or securely gated, except possibly against entry by vehicles. Residential properties border the site property to the north, northwest and southeast. The property line is densely wooded and a steep bedrock slope overlooks the site from the north. The nearest school is located approximately 0.5 mile south of the site, and no day care facilities reportedly exist within at least that radius (Refs. 3, 18). The scope of the current PA included a passive soil gas (PSG) evaluation. PSG sampling was conducted using a “Besure” passive soil-gas sampling kit, provided by Beacon Environmental Services, Inc. (Appendix B). DAFCO TotesNCS000002196Preliminary Assessment Ms. Bramble July 27, 2022 Page 7 PSG samplers were emplaced at six outdoor locations on the site property. PSG sampler DT04SG was emplaced within exposed soil in an area in the northeastern portion of the site, where stored totes had previously been visible on historical aerial photographs (Ref. 7). PSG sampler DT01SG was emplaced at a downgradient southwest location adjacent to the site entrance. PSG samplers DT02SG and DT03SG were placed along the south property line between the active site parcel and residences and businesses to the south and southeast, respectively. PSG samplers DT05SG and DT06SG were emplaced along the north property line, between the site and residences to the north and northwest (Ref. 18; Fig. 2; Appendix A). PSG samplers were deployed on May 26, 2022 and retrieved on June 6, 2022, after 11 days of equilibration (Ref. 20). At each soil vapor sampling location, a 1.5 inch-diameter hole was power-drilled into the ground surface to a depth of 1.0 foot. From the bottom of the borehole, a 0.5 inch-diameter borehole was further advanced to a total depth of 3 feet. The PSG samplers were suspended by metal wire into the upper boreholes. Compacted aluminum foil was used to anchor the upper sampler wires and to seal the upper boreholes from the atmosphere. Following retrieval, samplers were secured and shipped to Beacon Environmental for VOC analysis (Ref. 18; Appendix B). Beacon analyzed the PSG samples using EPA Method 8260C, for chlorinated and non- chlorinated volatile organic compounds. A duplicate analysis (DT04SGDup) was performed on source area PSG sampler DT04SG (Appendix B). PSG sample results are summarized in Appendix B of this report. Toluene (15.1 µg/m3; 20.8 µg/m3) was detected in PSG sampler DT04SG. All other PSG sample results were non-detect for VOCs (Appendix B). The NC Superfund Section evaluated the above PSG sample results using the EPA’s Vapor Intrusion Screening Level (VISL) Calculator. None of the results exceeded Target Sub-slab/Near- source Soil Gas concentrations, based on a Commercial Carcinogenic/Non-carcinogenic Risk of 1.0E-6 and Hazard Quotient of 0.1 (Ref. 19). Based on the above sampling results, the off-site exposure hazard posed via the subsurface intrusion component of the soil exposure and subsurface intrusion pathway appears to be minimal. Preliminary Assessment Conclusions: The site was tasked for a PA following a voluntary removal of leaking wastewater totes from the site by one of the responsible parties, with EPA Region 4 oversight. The purpose of the PA was to address the subsurface (vapor) intrusion exposure pathway, for which chlorinated VOCs were the primary potential contaminant of concern at this site. Results of PSG sampling on the periphery of the active parcels properties indicate that a minimal off-site exposure hazard exists as a result of historic site activities. Laboratory QA/QC procedures included internal standards, surrogates, and blanks based on EPA Method 8260C. Analyses and reporting were under BEACON’s Quality Assurance Project Plan. Passive Soil-Gas Survey Notes If sample locations are covered with or near the edge of an impervious surface (e.g., asphalt or concrete), the concentrations of compounds in soil gas are higher than if the surfacing was not present. Therefore, the sample location conditions should be considered when comparing results between locations. Survey findings are exclusive to this project and when the spatial relationships are compared with results of other BEACON Surveys it is necessary to incorporate information from both investigations (e.g., depth to sources, soil types, porosity, soil moisture, presence of impervious surfacing, sample collection times). Reporting Limits The RLs represent a baseline above which results meet laboratory-determined limits of precision and accuracy. All reported results are within the calibration range. The project method quantitation limit (MQL) is the limit of quantitation (LOQ) as noted in the data tables. Beacon determined uptake rates for a suite of compounds with the Beacon sampler for sampling in air. Beacon calculated the uptake rates for the remaining compounds using Grahams Law of Diffusion. The reported data includes LOQ limits. Project Details Samples were received in proper condition and laboratory control parameters were met unless otherwise noted below. The work performed was in accordance with ISO/IEC 17025:2017, except compounds reported with are not included in Beacon’s scope of accreditation.
