Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS According to the operator, the facility is closed and is no longer accepting waste. The facility is secured by a locking gate and the facility was not operating during this inspection. 1. 15A NCAC 13B .0302 (b)(1), “When a site ceases the acceptance of waste, closure of the site shall comply with the following requirements: (1) The owner or operator shall remove all waste from the site property and dispose of it at a facility permitted by the Division to receive such waste no less than 120 days after the date the site ceased the acceptance of waste.” During this inspection, a considerable amount of waste was identified at the site and must be removed before a final closure inspection can occur. 2. Types of waste to be removed include windblown waste throughout the facility grounds, including within standing water; commingled fine and large waste on top and behind tipping floor barriers and within operating areas; scrap metal; cardboard; scrap tires; wood waste; and a large pile of inert debris/concrete waste. Ensure all waste is removed from the site and disposed of properly in accordance with the rules and operations plan. 3. Remove any waste from the sediment basin and ensure that the basin is functioning properly. 4. There were several areas identified, including sections of the driveway, where crushed mixed waste (metal, tile, plastic, etc.) had been spread out on the ground. Commingled crushed waste should be removed and disposed of properly. 5. This facility includes a C&D waste sorting line which has not been in use since the start of the pandemic due to overall reduction in waste intake. 6. As noted in the previous inspection, two monitoring wells were observed along the right side of the access road and west of the scale house. Ensure these monitoring wells are identified as to their purpose, and if no longer in use, ensure they are properly abandoned. 7. 15A NCAC 13B .0302 (b)(4), “The owner or operator shall notify the Division in writing that the site has been closed in accordance with this Rule.” 8. 15A NCAC 13B .0302 (b)(6), “When a site has been closed in accordance with this Paragraph, the permit is terminated, and any future solid waste management at the site shall require a new permit.” 9. Remove all waste and dispose of properly at a permitted facility and ensure that all notifications are submitted to permitting as required. 10. A final closure inspection may occur once submittal of written closure notification is confirmed, and all waste has been removed. 11. Digital photographs were taken during this inspection.
