STATUS OF PERMIT:
The Small Type I Facility operates under Yard Waste Notification (YWN) #56-013.
PURPOSE OF SITE VISIT:
Comprehensive Site Inspection.
STATUS OF PAST NOTED VIOLATIONS:
None.
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .1402(g)(1)(A) partially states: "notification to the Division prior to operation and on an annual
basis." An annual YWN Renewal Form for the facility was not received by June 1st as required.
To achieve compliance, within fifteen (15) days upon receipt of this inspection report, the facility must submit a
YWN Renewal Form to the Section for the Town of Old Fort Yard Waste Site #YWN-56-013.
On January 17, 2023, Mr. Riddle emailed Chief Lytle to inquire about the submittal of the facility's annual YWN
Renewal Form. On this same date, Mr. Riddle received communication from the Town of Old Fort the YWN Renewal
Form had been submitted to the Section. On January 31, 2023, the Section approved the YWN Renewal Form for the
facility. This violation is considered RESOLVED.
2. 15A NCAC 13B .1406(6) states: "A site shall only accept those solid wastes that it is permitted to receive." The
YWN Renewal Form for the facility states the site will accept woody debris and "fallen trees from storms".
During this inspection, unpermitted waste was observed at the site which included metal, engineered wood, and

untreated wood (photo #1). Post -inspection, on January 23, 2023, Mr. Riddle telephoned Chief Lytle to discuss
the unpermitted waste observed at the site. Chief Lytle stated the material was from an apparent small awning and
recently a (now former) Town employee had placed the material in the waste pile. Chief Lytle further stated the
material would be removed from the waste pile and properly disposed.
To achieve compliance, within (30) thirty days upon receipt of this inspection report, the facility must remove
the unpermitted waste from the waste pile and ensure its proper disposal.
On January 25, 2023, Chief Lytle contacted Mr. Riddle to state the unpermitted material(s) had been removed from
the waste pile (photos #2 & #3) and would be disposed of properly. Chief Lytle also stated town employees would
work to ensure unpermitted waste is not accepted and/or delivered to the site. This violation is considered
RESOLVED.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Site access is located at 1174 East Main Street (U.S. Highway 70) in Old Fort, NC, behind the Auria manufacturing
plant. The site is adjacent to the Town of Old Fort's Wastewater Treatment Plant.
2. Site access roads were maintained during this inspection.
3. All minimum buffer requirements appeared to be maintained during this inspection.
4. The facility operational area appeared to occupy less than 2-acres during this inspection.
5. During this inspection, the amount of processed and unprocessed material on -site appeared to total less than 6,000
cubic yards.
6. As discussed post -inspection, maintain waste screening efforts at the facility.
7. Surface water appeared to be diverted from all operational and storage areas at the site. Continue to maintain
diversion measures for surface water control on -site as necessary.

9. Continue to maintain erosion control measures at the site as necessary.
