STATUS OF PERMIT:
A Permit to Operate “0501-MSWLF-1993 MSW Landfill Phases 1, 2, 4, 5 & 6” and “0501-LCID-2020 Land Clearing
and Inert Debris Landfill” was issued Ashe County on March 17, 2022.
PURPOSE OF SITE VISIT:
Comprehensive Inspection

OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility consists of a Municipal Solid Waste Landfill (MSWLF), Land Clearing and Inert Debris Landfill
(LCID), scrap tire collection area, and a white goods collection area.
2. The facility has a service area of Ashe County only.
3. A gate was provided at the entrance to the facility to prevent unauthorized access.
4. Severe wind gusts were experienced at the facility during the inspection.
Records Review:
1. The Permit to Operate and Operations Plan were verified. Both documents were current and available upon
request.
2. Tonnage Records for July 2022 – present were verified. The facility received 11,582.98-tons of waste during this
period.
3. Groundwater sampling was being performed semiannually as required. Records for 2nd semiannual sampling for
2020 (performed November 18-19, 2020), 1st semiannual sampling for 2021 (performed June 8-9, 2021), 2nd
semiannual sampling for 2021 (performed December 1-3, 2021 and March 3, 2021), and 1st semiannual sampling
for 2022 (performed June 14-16, 2022) were verified.
4. Leachate sampling was being performed semiannually as required. Sampling was performed concurrently with
groundwater sampling events.
5. Methane monitoring was being performed quarterly as required. Records for sampling events performed on
3/30/21, 6/9/21, 9/23/21, 12/2-3/21, 3/3/22, 6/16-17/22, 8/9/22, and 11/16/22 were verified. No exceedances above
applicable standards were observed.
6. Waste screening reports were verified for July 2022 – January 18, 2023. Reports appeared to have been performed
with adequate frequency and provided good documentation as to the make-up of each waste load observed.
7. A random sampling of Scrap Tire Certification Forms was reviewed. Majority of forms were properly completed.
However, additional effort is needed to ensure the number of tires handled, and signatures are provided at all
designated areas on the forms.

Operations Inspection of the MSWLF Unit:
10. Waste was being placed in the southwest corner of Phase 4 at the time of the inspection.
11. The working face was very small and compact.
12. No unacceptable waste streams were observed.
13. Facility staff were placing soil over the working face between waste off-loads to prevent windblown waste from
escaping the area due to severe winds experienced at the time of inspection. Facility staff were also picking up
waste at the time of inspection. Thank you for your efforts to control windblown waste.
14. Good soil cover was observed on all inactive portions of the landfill.
15. Edge-of-liner markers were in place around the perimeter of the landfill.
16. Access roads were of all-weather construction and well maintained.
17. During the inspection, Mr. Hurley explained the County plans to remove soil from two new borrow areas on the
property. However, no information has been submitted to the Solid Waste Section in reference to expansion or
siting of additional borrow areas. Any plans to expand or site new borrow areas must be submitted to the Solid
Waste Section for review prior to implementation.

Operations Inspection of the LCID Unit:
18. The working face was well controlled and less than one-half acre in size at the time of inspection.
19. No unacceptable waste streams were observed.
20. This area was well managed.
21. An application to expand the LCID Landfill has been submitted to the Solid Waste Section and is currently under
review.
Operations Inspection of the White Goods Collection Area:
22. White goods are collected on a concrete pad adjacent to the recycling building. Facility staff remove CFCs and
mark the appliances with “GO”. Once CFCs are removed, the appliances are placed on the metal pile or loaded
into the trailer designated for metal collection.
23. This area was well managed.
Operations Inspection of the Tire Collection Area:
24. All tires were stored in a covered trailer located just west of the scale house.
25. This area was well managed.
Supporting Comments:
26. A convenience area for the collection of aluminum cans, glass, and wooden pallets is provided adjacent to the
primary access road just northwest of the scale house.
27. The leachate pond was observed during the inspection.
• Two aerators were in operation at the time of inspection.
• No concerns were observed with the visible portions of the liner.
28. Lead acid batteries are collected onto a wooden pallet located adjacent to the above ground storage tank designated
for the collection of used oil.
