David Powell, NCDEQ - SWS STATUS OF PERMIT: 7702 MSW Closed PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Bryan Leggett and David Powell met to discuss corrective actions at the Yard Waste Notification across access road from the Closed MSW. Mulch onsite at the YWN will be used for erosion control, vegetation establishment and additional cover dressing for the closed MSW and other areas around the County landfill site. Be sure not to use more than 3 inches in depth and mulch YW cannot be sued for Beneficial Fill. Older and more broken down, or composted over time, YW can also be utilized in this manner as well. The image below depicts the Closed MSW on the left, and down gradient is the YWN on the right. Along the roadway on the uphill side, between road and Closed MSW, there is a shallow ditch which conveys stormwater away from the road and keeps it from running onto the YWN. It has windblown trash and has filled up mostly with soil. This man-made conveyance should be restored to original design specifications and cleaned out, with trash removed to the Transfer Station or proper disposal site. Be careful not to enlarge or move the ditch or disturb the Closed MSW cap or cover. Be mindful of any seeps or potential leachate that could leak into the ditch and discharge. This should assist in keeping the down gradient YWN from being as wet in future and assist in corrective actions at the YWN View is NE.
