PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: ! small area left. Broken down excavator needs to be moved out of the way to finish covering the West end. OBSERVED VIOLATIONS: No new violations noted FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS: 01 - Mr. Newbern has 95% corrected the observed violations on the August 31, 2021 inspection report. 02 - There is one area where the concrete hasn’t been covered. On the West end, Mr. Newbern still needs to move the broken-down excavator out of the way and cover the small area of exposed concrete. This needs to be done ASAP to come in compliance and notify John College so a follow-up inspection can be done. 03 - The Air Curtain Burner (ACB) is not currently being used. Needs a new burn box. Vegetative debris are stacking up. 04 - Spoke with Mr. Elliott on 01/18/2023 and he will be contacting DWM’s permitting section to discuss combining the Notified LCID and the Yard Waste Notified site into one Treatment and Processing Permit. Ash plan needs to be incorporated into any New Permit. 05 - Signage and Security measures (locking cable, gates or fencing) have been put back in place. 06 - There were a couple of piles of screened out metal to be removed. 07 - Be sure to secure a source of enough cover material to keep this landfill covered monthly at 6 inches over ALL waste for the life of this Notified LCID. 08 - All vegetative waste is currently on the adjoining Notified Yard Waste Site (YWN-27-002) at the time of this inspection. 09 - Digital pictures were taken during this inspection and some attached to this report, Please contact me if you have any questions or concerns regarding this inspection report. ________________________________________ Phone: 919-268-1524 _ Email: john.college@ncdenr.gov Environmental Senior Specialist Regional Representative Sent on: January 18, 2023 X Email Hand delivery US Mail Certified No. [ _] Copies; * Andrew Hammonds – Eastern District Supervisor * Ken Elliott – Elliott Consulting The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Also, small pile of new concrete with scrap metal.
