STATUS OF PERMIT:
Expired 16 October 2022; a Permit Review Request for the next five-year phase of construction and operations has
been submitted to the Solid Waste Section. This request was received on 25 April 2022 and is currently under review.
PURPOSE OF SITE VISIT:
Comprehensive Facility Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS:
None applicable
OBSERVED VIOLATIONS:
1) 15A NCAC 13B .0563 (1)(a) states “The facility is to be operated for the disposal of land clearing waste,
inert debris, untreated wood, and yard trash.”
2) 15A NCAC 13B .0566 (1) states “The facility shall only accept those solid wastes which it is permitted to
receive.”
3) 15A NCAC 13B .0566 (3) states “All waste shall be covered with no less than six inches of soil monthly,
or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the
site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.”
4) 15A NCAC 13B .0566 (4) states “Areas that will not have additional wastes placed on them for three
months or more, but where final termination of disposal operations has not occurred, shall be covered
with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and

stabilized with vegetative ground cover or other stabilizing material. The Division may require further
action to correct any condition that the Division determines may be injurious to the public health, or a
nuisance to the community.”
5) 15A NCAC 13B .0566 (5) states “erosion control measures, structures, or devices shall be utilized to
prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 15A NCAC 04.”
Please see the ADDITIONAL COMMENTS section below for details concerning the violation(s) listed above.
ADDITIONAL COMMENTS:
1) This Facility is a Land Clearing and Inert Debris Landfill.
2) This Facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood,
uncontaminated soil, and inert debris such as unpainted rock, brick, concrete, and concrete block.
3) The Facility is secured by means of a locked gate at the Facility entrance and has controlled access for safety.
The gate was open upon my arrival and Facility personnel were on site during this Facility Compliance
Inspection.
4) The Facility access road is of all-weather construction and is being maintained in overall good condition at
this time.
5) Overall, this Facility has a well-established cover crop of native warm season grasses in the inactive areas of
the landfill. However, areas of sparse cover were observed on the outside slopes of the landfill. *Within thirty
days of receipt of this Facility Compliance Inspection Report, please seed and mulch all areas of sparse cover
to establish a groundcover suitable to prevent erosion of your landfill cap system.
6) The Facility cover crop is mowed throughout the growing season as needed.
7) Proper signage is posted at the Facility Entrance stating the permit number and waste types received.
8) The waste type in the landfill was reviewed. Overall, the waste type being disposed was LCID, however,
unpermitted waste consisting of household trash and construction/demolition waste was observed disposed at
the working face. Also, some vegetative waste was observed to have been disposed at the site in brown paper
yard waste type bags and plastic garbage bags. These bags are not approved for disposal at LCID Landfills.
All approved waste brought to the Facility in these bags must be removed from the bags before disposal and
the bags removed from the site and disposed at a Facility permitted to receive such wastes. *Within thirty
days of receipt of this Facility Compliance Inspection Report, please remove all unpermitted waste and
properly dispose at the Onslow County MSW Landfill, permit #67-09. Moving forward, please ensure that all
bags are removed from the site when the waste is brought to the LCID Landfill.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

9) The active working area does not appear to be covered monthly as required. *Within thirty days of receipt of
this Facility Compliance Inspection Report, please compact all active working areas and cover with no less
than six inches of compacted soil. Moving forward, please ensure the active working area is covered with six
inches of suitable soil monthly, or when the active working area reaches one acre in size, whichever comes
first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions
associated with fire, windblown materials, vectors, or excessive water infiltration.
10) Scrap concrete, brick, and asphalt has been staged on the top lift of the landfill in an area adjacent to the
active working face for future crushing and re-use. Some demolition materials, household trash, and yard
waste were observed disposed at the inert debris pile. *Within thirty days of receipt of this Facility
Compliance Inspection Report, please remove all unpermitted waste and properly dispose at the Onslow
County MSW Landfill, permit #67-09. Moving forward, please ensure that all yard waste and LCID waste is
maintained separate from the inert debris staging pile. Also, all metal reinforcing bar and/or wire should be
cut off flush with the surface of the concrete and removed for disposal or recycling. Any concrete with
attached insulation or mastic should be disposed at the MSW landfill.

11) *Please note that the State rules regarding recovered materials state that for a material to qualify as a
recovered material, the majority of the material (75% or more) must be sold, used, or re-used within the
calendar year of receipt.
12) *Corrective measures are required as a result of this Facility Compliance Inspection Report.
