OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626(2)(b) states: "Except as provided in Sub -Item (c) of this Item, the owners or operators of
all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating
day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and
scavenging, and to minimize fires and the generation of odors."
An area approximately 20 feet by 80 feet of exposed waste was observed on the west-southwest slope of the
landfill. The waste was covered with heavy frost, indicating that the waste was from a previous day's operation.
Haywood County and Santek Environmental Services of North Carolina, LLC are in violation of 15A NCAC 13B
.1626(2)(b) in that they failed to cover all waste with six inches of earthen material at the end of each operating
day.

To resolve the violation, Haywood County and Santek Environmental Services of North Carolina, LLC
must immediately cover all exposed waste and cover all waste at the end of each operating day.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on December 28, 2022.
2. The section received multiple odor and landfill gas complaints from citizens in the neighboring community. Prior
to the inspection, a brief canvasing of the area was conducted. At the conclusion of the inspection the surrounding
neighborhood was toured again. No odor was detected during either investigation.
Operations Inspection of the MSWLF Unit (4407-MSWLF-1993)
3. The facility is currently filling in 5A.
4. An area approximately 20 feet by 80feet of exposed waste was observed on the west-southwest slope of the
landfill. The waste was covered with heavy frost, indicating that the waste was from a previous day's
operation. Facility staff confirmed that the uncovered area was from the previous day's operation. Mr.
Kirkpatrick stated that staff were unloading new wind fencing from a delivery and "ran out of daylight" and did
not finish covering the waste. The top and the remaining cell side slopes had good soil cover. Facility staff sent
photos showing the area was covered at the end of the day. 15A NCAC 13B .1626(2)(b) states: "Except as
provided in Sub -Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed
solid waste with six inches of earthen material at the end of each operating day, or at more frequent
intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to
minimize fires and the generation of odors." See Observed Violations section of this report for additional
information.
5. No unapproved waste was observed on the working face at the time of inspection; however, a blood bag was
observed to the south of the working face on the top of the cell. Per 15A NCAC 13B .1202(i)(6),
"Noninfectious medical waste and blood and body fluids in individual containers in volumes of 20 milliliters or
less may be disposed of in a municipal solid waste landfill or treated by the treatment methods as described in
this Paragraph. Blood and body fluids in individual containers in volumes of 20 milliliters or less may also be
disposed of in a sanitary sewer. The requirements of this Subparagraph shall not prevent noninfectious medical
waste such as textiles, plastic, glass, or metal from being recycled." If medical waste is going to be disposed
of in the landfill, ensure that the waste meets the requirements of 15A NCAC 13B .1202.
6. A light landfill gas odor was detected at the tipping area; however, a heavy landfill gas odor was detected in the
southwest corner of Phase 5, near the access roads and cleanouts. A temporary landfill flare had been installed
in this area and was burning during the inspection. There is a possibility of the odor moving off property if the
atmospheric conditions are right. Other ways to mitigate the landfill gas odor should be explored to prevent the
possibility of landfill gas odor migrating off property.
