PURPOSE OF SITE VISIT: Complaint Investigation STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 13B .0566 (10)(a) states: "Open burning of solid waste is prohibited, unless approval has been obtained from the Division, the local government, and the Division of Air Quality in accordance with 15A NCAC 02D .1900 prior to any burning activity. " South Iredell Volunteer Fire Department Station 12 responded to a fire at this facility the morning of December 24, 2022. During the inspection performed on December 28, 2022, minimal smoke was observed escaping through vents on the side slopes of the landfill. Waste in the landfill was observed covered with soil and facility staff were actively applying additional soil cover to areas where smoke was escaping. Therefore, Hwy 3 LCID LLC is in violation of 15A NCAC 13B .0566(10). Immediately discontinue acceptance of waste until the fire has been completely extinguished. Notify Kim Sue, Environmental Senior Specialist, once the fire has been extinguished and it is deemed safe to work within the landfill area. B. 15A North Carolina Administrative Code 13B .0566 (10)(d) states: "The owner or operator shall provide verbal notification to the Division of fires that occur at the site within 24 hours of the fire and shall submit written notification to the Division within 15 days of the fire. The notification shall include the site name and permit number; the date and time of the fire; actions taken by the owner or operator in response to the fire; the cause of the fire; the location and size of the fire; the type and amount of waste that caught fire; a plan of action to prevent fires in the future; the name and title of the person submitting this information; and the date the information is submitted. " Page 2 of 5 FACILITY COMPLIANCE INSPECTION REPORT DE QQ�� Division of Waste Management MI-1 °1Ell, N.Idy Solid Waste Section Mr. Mills did not provide verbal notification to the Division for the fire that occurred on December 24, 2022, nor has a written notification been received by the Division within 15 days of the fire. Therefore, Hwy 3 LLC is in violation of 15A NCAC 13B .0566(10)(d). To achieve compliance, submit the notification for the fire that occurred on December 24, 2022, notify the Division verbally within 24 hours and submit a written notification within 15 days of any fires that may occur during the operation of this facility. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Site consists of a Notified Land Clearing and Inert Debris Landfill. The facility is approved for the disposal of land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood and yard trash. 2. Proper signage was posted at the entrance. 3. The facility is secured by a gate at the entrance to prevent unauthorized access. 4. Tracy Wise is the site attendant and all haulers check -in at the office with each load. During the inspection on December 28, 2022, loads of soil were being delivered. 5. The entrance roadway is of all-weather construction, made of compacted stone, and was found to be in good condition at the time of the inspection. 6. On December 28, 2022, the waste in the landfill was covered with soil with minimal smoke escaping through cracks in the soil on the side slopes. Please see the Observed Violations section of this report. 7. Mr. Mills provided photographs on December 30, 2022, documenting additional soil applied sealing the side slopes.
