PARTICIPANTS: Ashley J. Ward, Solid Waste Director (called in from leave) John College, NCDEQ-DWM-SWS-FOB STATUS OF PERMIT: Active, Life of Site Permit. Issued April 10, 2019 and Expires 12/15/2055.
PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective Actions are in process. OBSERVED VIOLATIONS:

ADDITIONAL COMMENTS:
1. Facility has new Life of Site Permit. Issued April 10, 2019 and Expires 12/15/2055. Reviewed Permit and Operations Plan. 2. Facility is permitted to receive MSW within Hertford County. 3. MSW is transported to East Carolina Regional Landfill in Bertie County permit number 0803-MSWLF-1993. 4. Facility has adequate signage. 5. Facility has fencing with locking gates for security. 6. Interior roadways are constructed of all-weather materials and maintained. Except the entrance to the Yard Waste (YWS) site. 7. The Yard Waste has gotten out of control due to the road entrance at the YWS has no rock road and vehicles are getting stuck. Need to correct this issue ASAP. 8. There are now 2 large piles of YW up front that need to be moved and or ground up as mulch. You can only have 6000 cubic yards of unprocessed and processed material onsite at any given time. 9. Screening records and incoming load records were not reviewed during this inspection. 10. Windblown trash was not an issue during this inspection except where the empty compactors and roll off cans are stored. This area also must have ALL trash picked up by the end of each working day. 11. The repairs to the back wall of the transfer station, has not been replaced/repaired. Contractor has been retained but has been backed up. 12. Facility has placed Jersey Barriers along the back wall area to keep waste on the tipping floor at this time. No waste or leachate was noted off the floor due to this issue. 13. Upon arrival, the tipping floor was 2/3 or more full of waste, the compactor was full and no empty roll off containers to place waste in. Traffic was still being allowed to dump onto the floor. 14. Staff contacted Ashley J. Ward, Hertford Co. SW Director (Was on Leave) to notify her of this issue. 15. John College also had already call Mr. David Cotton, Hertford Co. Managers office and left a message for him to call (11:59 am) ASAP due to issues at this facility. Mr. Cotton replied to John College at 2:00 pm. John College informed him of the issues and requested an in-person meeting. John College will set this meeting up with Mr. Andrew Hammonds (DWM, FOB, Eastern Area Supervisor, John’s supervisor) to discuss ongoing issues at this facility. 16. Ms. Ward arrived at this facility and after discussions with John College, Ms. Ward called GFL to inquire about the waste removal. That discussion was relayed to John College that this facility would have containers and compactor brought in around 1 pm. Site was closed until enough containers and compactor space is available to remove waste from the tipping floor with none left overnight. 17. The containment area around the oil storage has collapsed and will be repaired during the rear wall repair work. 18. Since this report was started, John College has scheduled the meeting mentioned above (15) with Mr. David Cotton, Hertford Co. Manager (per phone conversation), Ashley J. Ward, Hertford Co. Solid Waste Director (per this report), Mr. Andrew Hammonds, DWM, FOB, EA Supervisor (per electronic meeting invite) to be held at the Transfer Station on January 10, 2023 at 1:15 pm.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
