Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell met with Moore County staff to conduct a comprehensive inspection. Inspection was also for Section Staff to meet new faces that are involved with landfill at Moore County, now that Mr. David Lambert is no longer Solid Waste Director. In addition, Interim Director Philip Boles is soon leaving for retirement again and Mr. Jimmy Brown about to retire, with potential of returning part time. Roads were of all-weather construction, and facility is behind gate/fence beyond entrance. A dust vehicle is being purchased and should arrive around February. 2. Yard waste (YW) material didn’t have any visible unapproved waste during inspection. Good job. 3. Waste onsite was mostly in windrows except raw yard waste coming into T and P. The waste being accepted is pushed into a large mound until it is mulched then its put into a windrow. This method is a fire hazard and all waste onsite needs to be windrowed and have firebreaks. Access should be maintained around entire facility and in between each windrow for firefighting access. Some windrows were touching each other and had no separation. Storage pile/windrows of all types must be limited to 30 feet high, and 50 feet wide based on the T and P approved operations plan. Separation is needed of the raw YW onsite and for any future waste accepted. Grading or building up of a soil pad for YW should be done to keep stormwater from comingling with YW and becoming leachate or from YW standing in water. Permit Attachment 3, Part VII. (3) - Surface water shall be diverted from all operational and storage areas to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste, is deemed to be leachate and shall be contained on-site or properly treated prior to discharge. West side T and P Area 1, good windrows of mulched YW. Stormwater needs better management. Eastern side of T and P, raw YW accepted here currently, need windrowing and fire breaks. Engineered woods (pallets) waste must be kept separate from other piles and cannot be distributed for compositing but may be sent as boiler fuel. Pallets are banned form landfill, except if generated by C and D activities and come to landfill in that waste. 5. There is still a good amount of material onsite. Just remember, moving forward this material is supposed to be moving out, not just coming in and staying. Once Moore County catches up with removing old material, compliance in this area will be maintained easier, it is also being mixed with soil and being used as alternative cover on CDLF. It was discussed onsite that the County grinds and windrows twice a year, but this may need to be increased. Permit Attachment 3, Part VII. (2) - Seventy-five percent (75%), by weight, of the recovered material stored at the facility at the beginning of a calendar year commencing January 1, must be removed from the facility through sale, use, or reuse by December 31 of the same year. 6. All YW is mulched and mostly either gets composted or it goes to boilers. Some mulch is used for ADC at Moore County CDLF, erosion control or to assist with vegetation establishment around facility or closed MSW, or offsite locations that mix it into compost or soil for soil amendments. Some off-site locations consist of Uhwarrie landfill, Brooks or Walburg Sand. County is also working with Carolina Tire for using some for-erosion control on side slopes etc. on their landfill. 7. Some temperature records were available and reviewed. Operations plan, annual reports certifications, vendor contracts, previous inspection reports, waste screenings, daily checklist, and load checks for facilities onsite were also reviewed. Remember compost temperatures must be 131 degrees F for three consecutive days, not average. All compost must meet 15A NCAC 13B .1400 rules before can be given to public. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 7 8. A map was available, but a more professional and accurate map is needed. A map with windrows identified to use with waste onsite should match up so they can be managed appropriately with turning, temperature recording and locations of each. This is needed to ensure all waste is managed the same and all meet rule before leaving Moore County’s T and P and ensures public health by doing so. The map may need a couple years represented, due to annual operations from year to year and rotating back and forth. The County should design what’s needed for their current approved operations and what’s most economical. Please design and submit to Section permitting to record with other approved documents. This map should be what onsite staff use for operations and identification for each windrow onsite may be needed too. Be sure map has relevant buffers marked. (It would be good to mark buffers onsite as well for onsite staff to know where not to go.) Temperature records in file should match accordingly to the maps identification for each windrows etc. Area 1 current map in records. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 6 of 7 9. County has spent about $350,000.00 in recent year for processing, hauling and removal of YW. Mr. Boles report in part for, “FY 2021/2022 approximately 21,810 tons of waste received, 11,100 tons of mulch hauled to Brooks Farm. Simmons & Simmons completed grinding of 13,975 tons of accumulated yard on August 11, 2022. This was the accumulated yard waste from January 29, 2022, through August 11, 2022 (approximately 6 ½ months’ worth).” 10. Area 2 for the T and P storage is located between access roadway to CDLF and T and P and the Transfer Station and scrap metal. It has had most of the older waste removed but some work is still needed and being done. Remove all older waste and replace with soil to build up this area. Older composted waste may look like soil but it is still considered waste. Currently it is lower than surrounding ground and holds water. This area is also used storing of older roll offs. Remove waste, build up this are where stormwater is shed from this area without erosion and keep clean/clear for T and P storage. Area 2, Transfer Station in rear view. 11. All operators and managers associated with operations at the T and P should be familiar with 15A NCAC 13B .1400 rules but especially .1406, which is the OPERATIONAL REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES. In addition, 15A NCAC 13B .0300 rules but especially .0302 OPERATIONAL AND CLOSURE REQUIREMENTS. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 7 of 7 12. Corrective actions are necessary as result of this inspection. Corrective actions should be completed within 30 days from the date of this inspection report sent. Failure to resolve these matters may result in further enforcement action.
