The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. All photos included in this report were taken by Robert Pike during the inspection on December 12, 2022. 2. The facility is a permitted LCID landfill, wood waste and inert debris treatment and processing operation, and a Large Type 1 compost facility (permit # 3427-COMPOST-2015) 3. The facility compost and treatment processing areas were operating at the time of operation. 4. The Permit to Operate and approved Operations Plan are maintained at the facility for review upon request. 5. A load ticket is prepared for each incoming load of waste. Tickets are kept on file at the owner’s home office, where volumes are converted to weights and compiled into monthly tonnage. Load tickets are available for review upon request. 6. The Facility Annual Report for fiscal year 2021-22 were reviewed. FAR indicated that a total of 2,148.00 tons of waste was received at the facility for processing as compost or mulch. 7. Composting temperature logs are maintained at the facility and are available for review upon request. Temperature logs were revied during the inspection. Field Inspection: 8. The entire facility was inspected and found to be clean and well maintained. 9. The facility access roadways are of all-weather construction and in good condition. 10. The facility is secured by perimeter fencing with site access being secured by two locking gates. 11. Proper signage was observed. 12. The LCID landfill is located on the northern portion of the facility. Mr. Lawson stated that the LCID landfill has started the closing process and has applied the soil cap and seeded the landfill. The landfill cap was observed to be in good condition with vegetation starting to establish. 13. Permanent edge of waste markers were observed around the perimeter of the landfill. 14. The treatment and processing operations take place on the southern portion of the facility. Wood waste and compost operations are located on the western half of the treatment and processing area with a stockpile of asphalt debris. Inert debris consisting of concrete is located on the eastern side of the treatment and processing area. 15. Compost and wood waste operations take place on the south side of the treatment and processing area. A small amount of old compost was noted, along with several piles of mulch and topsoil. During the inspection four piles of composted material were observed. 16. The wood waste used for mulching operations are stockpiled adjacent to a large tub grinder. The stockpile was inspected, and no unacceptable material was found. The processed wood waste is then transferred and placed in windrows. 17. No unacceptable materials were noted in the wood waste/compost operations area or in the stockpiles of processed and unprocessed material. Wood waste stockpiles were neat and of a manageable size, with adequate fire lanes surrounding each individual pile. 18. The inert debris pile consisting of concrete was of a manageable size with Bobby Lawson stating that after enough material has been stockpiled crushing operations would take place. During the inspection, three pieces of yellow painted concrete was observed on top of the inert debris stockpile. As part of routine operations, the facility was removing the painted material from the clean material that day. Ensure that the facility only accepts the material that it is permitted to receive, unpainted and uncontaminated rock, concrete, brick, and concrete block. 19. The treatment and processing area is designed to direct stormwater runoff to a pond on the eastern side of the facility. A drainage ditch runs along the southeastern edge of the operations and storage area into a pipe that conveys the runoff directly down the hill to the pond. The pond, which was viewed from above, appeared to be clean and well-maintained, as did the ditch line. The surrounding slope leading down from the operations and storage area to the pond is covered with well-established vegetation. All erosion control measures appeared to be functioning properly, and no erosion was evident. 20. All required buffers and setbacks appeared to have been maintained at the facility, including the 100’ buffer surrounding the water supply well located in the treatment and processing area.
