Previous site was a 2 Acre Notification July 2016 (N1092); Emergency Approval for One acre expansion, (Total 3 Acre LCID) on 10/18/2018; March 17, 2022 - Permit to Construct 7803-LCID-2022 4 Acre expansion; Permit to Operate current 3 Acre LCID. December 13, 2022 - Permit to Construct 7803-LCID-2022 4 Acre expansion; Permit to Operate current 3 Acre LCID (this was reissued to address wording and some issues with 3/17/2022 PTC/PTO.) The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Purpose of visit was to do a comprehensive inspection on the Robeson County Landfills. Facility is secured by
gate/fence, with a road made of all-weather construction. An operator was onsite during inspection visit. This previous NLCID had been approved for an additional One (1) acre of LF added to the Two (2) acre, total of Three (3) acres, notification on October 18, 2018, by the Section, due to increase demand from recent hurricanes. A
PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for construction of the additional 4-acre section. Construction has not begun on these additional acres. A preoperational inspection will be needed, long with other conditions met, before operations can begin in new 4-acre section once constructed. 2. Signage needs to be updated to reflect new rules and permit. The signage needs to be updated for new permit conditions for other facilities as well. The main sign can be altered to fit all, but to minimize confusion it is suggested to add a sign at the entrance for each operation at the landfill facility to reflect the required information. If updating the current main entrance signage, it should have the types of waste accepted, phone numbers, including afterhours emergency number, and the types of waste that shall not be accepted at the C&DLF unit and the MSWLF, such as liquid waste, hazardous waste. This may be confusing and cause issue with the public if all
put onto one sign, so be mindful and indicate the distinction of each site and its proper waste acceptance. County has additional signs but cumulatively doesn’t meet all rules. LCID - 15A NCAC 13B .0566 (14) - A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site.
CDLF - 15A NCAC 13B .0542 (j)(5) - Signs providing information on disposal procedures, the hours during which the site is open for public use, the permit number, and any information specified in the permit conditions to be included on the sign shall be posted at the site entrance. (6) - Signs shall be posted stating the types of waste that shall not be accepted at the C&DLF unit, such as liquid waste, hazardous waste, and municipal solid waste. MSWLF - 15A NCAC 13B .1626 (6) (e) - Signs providing information on disposal procedures, the hours during which the site is open for public use, the permit number, and any information specified in the permit conditions to be included on the sign shall be posted at the site entrance. (f) - Signs shall be posted stating the types of waste that shall not be accepted at the MSWLF unit, such as hazardous waste or liquid waste.

3. The NLCID mostly had good cover upon inspection. No visible unapproved waste was visible during inspection. Good job. There was a working face and then an area with uncovered waste on the southwest corner. Working face was approximately ½ an acre. Slopes were 3:1 or less, good job. Some waste was beyond Edge of Waste (EOW) markers on southeast corner. Please bring it back inside the approved area, cover and slope.

4. The perimeter was measured using a laser range finder and the acreage was calculated. It was determined that
the size was just under approximately 3 acres. EOW markers are needed along the western side of the LCID, between the EOW and the access road. One should be visible to the other. Access roads were of all-weather construction and around almost the entire perimeter.

5. Any areas that will have no waste or areas which are not going to receive waste in next 3 months, should have
the proper cover and be stabilized with vegetative ground cover according to rule. It depends on where the working face is moved in future etc., just be sure any area of the NLCID complies with this rule if it meets the requirements. 15A NCAC 13B .0566 (4) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community.

6. Some waste has rolled of the back side slope into some weeds and needs removal back inside the disposal area and covered. Please remove this waste and any other wastes from outside the EOW.

7. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted. 8.
