OBSERVED VIOLATIONS:
A. 15A NCAC 02C .0108(m) states “All non-water supply wells shall be equipped with a steel outer well casing or flush-mount cover, set in concrete, and other measures to protect the well from damage by normal site activities.”
The Town of Kernersville is in violation of 15A NCAC 02C .0108(m) for failure to have all monitoring well steel outer well casings set in concrete to provide adequate protection for site activities.
During the inspection, monitoring well MW-3 did not have a sufficient concrete pad surrounding the metal casing to protect the well from damage from normal site activities. To achieve compliance, the Town of Kernersville must repair or replace the concrete pad for MW-3 to

provide sufficient protection to the monitoring well.

ADDITIONAL COMMENTS
1. All photos included within this report were taken by Robert Pike on December 1, 2022. 2. The facility is a closed unlined landfill that stopped excepting waste on May 1, 1990. 3. The site is secured by local topography, river, and railroad tracks that border the site. Access to the site is
controlled by a locking gate located at the entrance. 4. The facility access road is of all-weather construction. The facility roadways were in good condition with some maintenance needed to address some small potholes and a fallen tree. 5. The landfill cap was in good condition and is covered in well-established vegetative cover. City of Lexington staff stated that the landfill is regularly mowed twice a year and is mowed more if needed. The landfill cap had one small area that held shallow impounded water visible due to the rain event that occurred the day before. Ensure that the landfill cap is maintained in a way to prevent the impounding of water and bring in clean soil to repair the depression. 6. Edge of waste markers were inspected. The green, white tipped metal post edge of waste markers have been replaced with large highly visible yellow metal poles. 7. During the inspection environmental monitoring wells were observed. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

lock and properly labeled. However, monitoring well MW-3 was not set in a protective layer of concrete as required. (See the Observed Violations section of this report for additional information.)
