Active Life of Site Permit (PTO) 3301-CDLF-1997 issued on July 14, 2020, and expires December 30, 2057 and combined with New (PTC & PTO) 3301-COMPOST-2020 issued July 14, 2020 and expires July 14, 2030. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS:
Corrective Action is still in Process. OBSERVED VIOLATIONS: No new observed violations were noted during this inspection.

ADDITIONAL COMMENT
01 - This Life of Site Permit approves the continued operation of the C&DLF Unit phases 1-9 and 3301-COMPOST-2020. The Permit to Operate for the Edgecombe County C&DLF was recorded in the Edgecombe County Register of Deeds on April 07, 2010 in Deed Book 1551 Pages 645-669. (DIN 10349).
02 - This facility is permitted to receive permitted waste generated in the following North Carolina counties:
Edgecombe, Nash, Halifax, Wilson, Pitt, and Martin. 03 - Facility Certified Landfill Operations Specialist: Gloria A. Moseley, expires 10/21/2023, and William Exum, expires 9/21/2023, and (primary operator) Brandon Kelly, expires 9/8/2024 04 - The primary operator (Brandon Kelly) is continuing to learn this operation. 05 - Continuous equipment breakdowns appear to be part of the reason this facility has cover issues. This was mentioned during this inspection. 15A NCAC 13B .0534 GENERAL REQUIREMENTS FOR C&DLF
FACILITIES AND UNITS;(2) (I); Rule attached to email. 06 - Please continue to keep adequate cover material on the working face so the operator can cover when needing to. Adequate cover material, compaction and seeding needs to take place on areas that will not have any waste added to reduce erosion and potential leachate breakouts. This was mentioned during this inspection. 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES; (f) (2) (3). (j) (2). Rule attached to email. 07 - No leachate was noted outside of the landfill footprint during this inspection. 08 - The leachate is still filling the temporary holding area that was pushed up a year ago. This area should be pumped daily or as necessary to prevent leachate overrunning the berm and being released. 09 - Recommend you contact permitting to discuss remedies for a more permanent fix to the leachate issues at this facility including your concerns of possible groundwater intrusion. This was mentioned during this inspection. 10 - Another inspection will be conducted to discuss corrective actions taken and needed to repair the leachate breakouts that have now been going on since found on November 08, 2021. 11 - A Notice of Violations was issued on November 17, 2021. 12 - If possible, Andrew Hammonds (DWM) will try to get one of DWM engineers to attend the next inspection for input. 13 - Minimal Staffing seems to be another part of the issues at this facility. This was mentioned during this inspection. 15A NCAC 13B .0534 GENERAL REQUIREMENTS FOR C&DLF FACILITIES AND UNITS; (2) (I); Rule attached to email. 14 - The C&D was closed during this inspection due to not enough staff to properly manage this facility. 15 - Need to mow the landfill so adequate inspections (by your staff and the state) can be done to ensure potential compliance issues are caught before they become a larger problem. 16 - Sections staff along with County representatives located a hole in a gas line during this visit. The line should be repaired as needed and the gas collection system inspected to ensure there are no other issues.
17 - Gloria Moseley, Solid Waste Director has kept John College informed of all the progress made to resolve
the NOV for this facility. 18 - Digital pictures were taken during this inspection and several are attached to this report. Please contact me if you have any questions or concerns regarding this inspection report.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
