The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell visited the Cumberland County HHW facility for an inspection. Renewal submittal was reminded in previous inspection. Submit renewal application immediately. Before this inspection was sent to the Permittee, an application notification letter was sent on 11/16/2022, that the application would be forthcoming.
2. Facility has a gate and is fenced. The facility is open second Saturday, 8am to 12pm, and fourth Wednesday, 12pm to 4pm, each month.
3. Inspector inquired as to if there were any problems since last visit and staff stated there has not been any
incidents or fires since last visit. Facility collects pesticides, corrosives, oxidizers, antifreeze, motor oil and flammables.
4. Sump outlets were closed during inspection. Fire suppression system is tested twice a year.
5. New employee starts on 11/21/2022 and will be 40 Hr. HAZWOPER certified.

6. EcoFlow is still used to remove the waste. NCDA collects the pesticides. Wastes are usually removed twice a year at least. Items in storage awaiting disposal all were labeled and had date. However, there are some wastes still stored with dates older than 180 days. Permit requires waste stay no longer than 180 days so be careful not to go over this time frame. County should have all wastes removed onsite that are older than 180 days. It may be best to have all wastes removed and then restart the 180-day clock to cut down on multiple disposal visits by a licensed hazardous waste contractor. Also, the date written on the label has mostly just the day and month. This needs to have the year as well. Suggest documenting with day, month and year on label.
Permit Attachment 3, Part VII, 13 - The date upon which each period of accumulation begins shall be clearly marked and visible on each container. Each container shall be labeled or marked clearly with the words “Hazardous Waste” unless the container separately holds recyclable material. The maximum period of accumulation for all HHW stored at the facility shall be no more than 180 days after initial receipt. Before the end of 180 days, the HHW shall be transported off-site for recycling, treatment, and/or disposal.

7. Inspection logs/waste screening forms, HHW checklist (when open and operating) were reviewed after inspection at facility. Be sure this is done at least twice a month as required by permit (Permit Reference Part VII. 8). Waste screening is done by staff when public brings a load. Anything not acceptable is taken
back out with the person who brought it. A copy of the permit was available onsite and a copy of the 40 Hr. OSHA HAZWOPER Certification training for Neal Cunnington (2020) and Virgilio De la Serna (2020). Timothy Middleton has now taken 40 Hr. Hazwoper in January 2022. Mr. Virgilio received an 8 Hr. refresher in 2021. All operators should receive 8 Hrs. of Continuing Education/Refresher a year. Certificates should be placed in records for review during inspection. Fire extinguishers were checked and had 2022 inspection tags.

8 Hour HAZWOPER annual refresher.
8. Facility looked neat and orderly upon inspection. However, inside there have been a couple spills. Some items need to be put into containers and not left on the floor where they can spill, become damaged and spill, react with each other or surroundings and potentially expose staff members. Both areas of concern are inside pesticide/insecticide building. One area is in the back left once you enter and one is just inside door to the right. The back left has wastes that have spilled and begun to react with floor or each other. A qualified professional should clean this building immediately. The second area, up front and right, is where bags of fertilizer, lime, misc. bags of powders etc. are stored by just setting them in a pile next to one another. Upon inquiry, staff indicated they do not get much of this waste annually. These waste types should be placed into proper containers to keep them contained, and prevent spills, reactions, and damage to the container they are already in once they arrived. Proper cleaning between use should be done once waste is removed by qualified licensed professional.

Inside same building as pesticide/insecticide, but this area is just inside door and to right. Clean and contain wastes. 9. Gas cans were piled up inside a building. They should be stood up to ensure nothing spills if anything is left inside. This is also a potential fire hazard. No dates were on these containers. All waste should be removed within 180 days by licensed hazardous waste contractor.

10. The HHW should have had its renewal submitted before June 13, 2022, and this was indicated on last inspection. Please submit renewal application immediately. Also, the County should look into upgrading some of the storage buildings. Currently they are much older surplus military buildings there are some in which have holes in the side or wall. This can provide access to vectors such as birds or raccoons etc. which may become exposed to the waste or spread it outside of the containment. New containers with secondary containment should be used for replacing older buildings. 11. Corrective measures are necessary as a result of this inspection. All of these corrective actions should be completed to meet closure and will be confirmed on follow up inspection and should be complete within 60 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
