CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(7) states that “Erosion and sedimentation control requirements. Erosion control measures consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 5A NCAC 04, which is incorporated by reference including subsequent amendments and editions.” During the inspection, the northern and western side slopes of the active landfill were observed to have been regraded. A berm had been constructed on the top of the side slopes. The facility stated that they are planning to install a slope drainpipe and that seeding is scheduled later in the week. OBSERVED VIOLATIONS: None. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. The facility is composed of a closed MSW landfill, a scrap tire collection area, a white goods collection area, scrap metal collection area, a collection and processing area for concrete, asphalt, and brick (CAB), and an active, lined MSW landfill. The closed MSW landfill was not inspected during this inspection. 2. The facility has a gas plant located across form the leachate storage tanks. 3. A residential convenience area is located Southwest of the scale house. Records Review: 4. The Permit to Operate and the approved Operations Plan are stored at the landfill officer and are available for review upon request. 5. Digital copies of the facility tonnage records were provided by Mr. Dively prior to the inspection for review. The FAR 2021-22 was reviewed and reported that the facility received a total of 297,426.14 tons of waste. The facility records from July 2022 through September 2022 were provided for review and reported that a total of 67,678.96 tons of waste has been received. 6. Incoming loads are randomly selected for inspection as required by the permit. Waste screening records were provided for review for August 2021 through October 2022. 7. A digital copy of the white goods and scrap metal collection program records was provided by Mr. Dively prior to the inspection. The records indicated a total of 416.70 tons for July 2021 through June 2022 and a total of 167.79 tons for July 2022 through September 2022. 8. A digital copy of the scrap tire collection program was provided prior to the inspection by Mr. Dively. The records indicated that the total tonnage for the fiscal year 2021-22 was 6,338.80 tons with the total tonnage of 1845.98 tons for July 2022 through September 2022. 9. Leachate tank inspections are conducted weekly by facility staff. Inspection forms were reviewed for September 2021 through October 31, 2022. 10. Leachate lines were inspected and cleaned on December 22, 2018, by JetClean America. Leachate lines are inspected and cleaned every five years. 11. The facility separates clean loads of concrete, asphalt, and brick (CAB) at the scale house and directs them to the CAB collection area on the eastern side of the active landfill. When the loads arrive at the CAB collection area staff inspects the material as it is unloaded to ensure no unpermitted material is accepted. Facility staff complete a log noting the types of materials received and if any material was removed to be disposed of on the active face. These records were reviewed for September 2021 through October 2022. 12. Ground water and leachate monitoring are conducted semiannually as required. The two most recent sampling events, September 2021 and March 2022, were reviewed. 13. Landfill gas monitoring takes place quarterly as required. The sampling is performed by the contractor that manages the gas extraction plant. The two most recent sampling events were provided by Mr. Dively for review. The records indicated sampling occurred on June 29, 2022 and August 16, 2022. 14. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility access roadways are of all-weather construction and were found to be in good repair. 16. The facility was observed to be clean and well maintained. Windblown litter was observed to be minimal with litter pick-up crews actively picking up any windblown litter on site. 17. Proper signage was observed at the entry gate and on the access roadway leading to the scales. Concrete, Asphalt, and Brick Collection Area: 18. Scale house operators identify CAB loads and directs them to the CAB collection area that is kept separate from the active landfill. 19. The CAB area is secured by a locking swing gate that is kept locked except when facility staff are present. Facility staff are present during any material unloading to supervise and manage the material. Any unacceptable material is identified and directed to the active working face for proper disposal. 20. The CAB stockpile was of a manageable size at the time of the inspection. Mr. Dively stated that the CAB stockpile is crushed and processed as needed to manage the material. 21. No unacceptable material was observed during the inspection. White Goods and Scrap Metal Area: 22. White goods and scrap metal are collected in an area located west of the CAB collection area. A facility staff member is on duty during operating hours. 23. White goods are staged on a large concrete pad. Units containing refrigerants are organized in un upright position and allowing easy access for the refrigerants to be removed. 24. Mr. Dively stated that the facility contracts with G-Gas Rapid Recovery to remove the refrigerants as needed. 25. Non-cfc white goods are kept on the opposite side of the concrete pad as the non-drained white goods. 26. Scrap metal is kept in a roll off container located near the large concrete pad. Scrap Tire Collection Area: 27. Scrap tire collection area is located to the west of the scale house. 28. The facility contracts with US Tire to operate the scrap tire collection area. 29. A total of 4 trailers were on site with two trailers full at the time of the inspection. 30. US Tire staff directs residents to back up to the loading dock where they offload the tires and load them into the trailers. 31. The scrap tire collection area has ample room to allow residents to maneuver there vehicles safely. Residential Convenience Center: 32. The residential convenance center is located to the southwest of the scale house o a concrete pad with trailer loading spaces below each drop-off location. 33. The convenience area is manned during operating hours. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 34. Signage is posted at each drop-off location identifying the type of material to be disposed in the location. 35. The residential convenience area was observed to be clean and well-maintained during the inspection. Active MSW Landfill: 36. Mr. Dively stated that at the time of the inspection waste was being placed into Phase 2 Cell 4. 37. The working face was observed to be of a manageable size with two equipment operators working to adequately compact the waste. 38. Traffic in the tipping area is managed by a spotter who directs traffic to ensure good traffic flow. 39. Soil is brought in from the borrow area throughout the day to use as daily cover and is staged by the working face. 40. The operations area was observed to be in good condition. 41. Landfill side slopes were observed to be in good condition with repair work just having been concluded to the Northern and Western side slopes. Mr. Dively stated that seeding crews were scheduled to seed the side slopes later that week. 42. The leachate collection system consists of two leachate storage tanks contained in a secondary containment pit. Both tanks appeared to be clean and in good condition during the inspection.
