STATUS OF PERMIT: Notified LCID – Preparing for closure PURPOSE OF SITE VISIT: Comprehensive Inspection - Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0567 (b) (2) - UNRESOLVED The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. David Powell following up on facility closure. Waste not being accepted at this NLCID. Closure activities should be completed onsite, and engineers should soon be visiting to confirm soil cover depths etc. Required documentation should be forthcoming, according to Mr. Duncan. 2. Site has had additional soil cover put on several areas of side slopes. According to Mr. Duncan, the engineering firm is forthcoming to confirm all repairs and soil depths and then should be preparing paperwork for submittal. Grass should be established for Winter and then perennial grasses established in spring for permanent cover. This structure should be maintained for 10 years post closure care, according to rule. Owners should have engineers come out quickly and verify soil cover depths and certify. Be sure all waste is inside the Two-acre notification, with an additional fifty-foot extension in southwest end of NLCID and meet buffers. A map of this should also be submitted showing limits of waste disposal and soil boring locations. This map should be recorded with County Register of Deeds. A letter to the Section stating that the owners, “Request closure and have completed closure according to Rule 15A NCAC 13B .0567 and will conduct Post Closure Care according to also according to Rule 15A NCAC 13B .0567 for ten years following closure.” In addition, this letter should include the name of the facility, notification number, owners name, return mailing address and contact information and be signed by the landowner. These can be sent via email to david.powell@ncdenr.gov or by mail. 3. Erosion rills have been addressed, soil has been added and sloped accordingly. South side. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 SW corner, soil added, EOW hardly visible, but present, in rear of frame. 4. Edge of Waste Markers (EOW) were visible on the corners of the NLCIDLF, and trees/shrubs have been removed as requested. Good job. Shrubs removed, soil added and sloped. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 Trees removed near toe, EOW marker out of frame. 5. Slopes looked good, with soil compacted and erosion repaired. Site could use mowing in some areas along bottom toe and perimeter road. Roads should be of all-weather construction. Please maintain and fix road access. Road access is still present around perimeter but may need some periodic maintenance to stay “all weather”. 6. Corrective measures are necessary as a result of this inspection. All of these corrective actions should be completed to meet closure and the closure documents submitted within 30 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
