OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0101 (28), “’Inert debris waste’ means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead-based paint.”
During this inspection the inert debris stockpile on the northside of the facility contained commingled waste including metal, plastic, silt fence, and painted brick and concrete. Refractory fire brick was also identified within the pile and could possibly contain asbestos. Commingled waste and painted brick and concrete do not meet the definition of inert debris as defined in 15A NCAC 13B .0101 (28). Ensure all prohibited commingled waste and painted brick and concrete block is removed and disposed of at a permitted facility.

B. 15A NCAC 13A .0566 (2), “Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.” During this inspection the northside slope of the landfill containing inert debris and commingled waste was identified as exceeding a ratio of three horizontal to one vertical. The waste boundary in this area appears to be encroaching on the adjacent property and within the required 100 buffer. Inert debris waste has fallen down the side
slope and into the tree line. Ensure the inert debris waste in this area is pulled back to maintain a 100-foot buffer from the property line and regraded to achieve a slope of 3:1.
ADDITIONAL COMMENTS
This facility is a LCIDLF and is permitted to receive for disposal land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt in accordance with N.C.G.S 130A-294(m).
1. Signs must be posted at the entrance to the facility that state that no hazardous waste or liquid waste can be received at the facility; and provide information on dumping procedures, the hours of operation, the permit
number, contact name, telephone number, and other pertinent information. Ensure posted entrance signs contain all required information. 2. Interior roadways were of all-weather construction and are maintained in fair condition. 3. Permit to Operate, Attachment 3, Part I (5), “Copies of this permit, the approved plans, and all records required to be maintained by the permittee must be maintained at the facility and made available to the Section upon request during normal business hours.” During this inspection, records could not be reviewed as facility personnel were unable to provide copies of the permit, approved plans, random soil screening or records. Ensure up to date copies of all pertinent documents are kept onsite and are accessible to all facility personnel. NCDEQ representative contact information needs to be updated. 4. Solid waste must be restricted to the smallest area feasible, compacted densely as practical into cells by proper construction management.
5. Excavation, grading, and fill material side slopes must not exceed three horizontal to one vertical (3:1). 6. All waste shall be covered with no less than 6 inches of soil monthly or when the active area reaches one acre in size, whichever occurs first by rule. The approved operations plan part 2.5.1 states that the exposed waste will be covered when it exceeds ½ are in size. 7. Permit to Operate, Attachment 3, Part VII (21), “The permittee is allowed to accept and manage partially hardened concrete as described in the approved plan.” The approved operations plan for this facility states in
part, “Trucks are permitted to back up to the designated disposal area, located outside the working face, dump excess concrete, and rinse off the chute.” During this inspection it was noted that partially hardened concrete was not confined to a designated disposal area. Mr. LaFerire stated that the partially hardened concrete was being leveled and used to stabilize facility roads, however the concrete was observed being dumped at random adjacent to and on top of facility roads, next to the inert debris stockpile, and left to cure in untended mounds. Run-off was observed originating from these uncured mounds, flowing over the facility roads, and terminating outside the edge of waste. Ensure partially hardened concrete is dumped only in the designated disposal area outlined in the approved operations plan and used solely for beneficial use on-site in erosion control, stabilization
applications, or road base. Run-off resulting from chute rinsing activities should be confined within the waste boundaries. Please provide an updated map showing the location as described in 2.7 and 2.8 of the approved operations plan.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

8. 15A NCAC 13B .0564 (6)(b), “Buffer requirements: A site shall maintain the following buffer requirements: 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells.” During this inspection, it appeared that the northern waste boundary is encroaching on the northern adjacent property and inert debris waste is falling into the tree line. The waste needs to be moved out of the trees and away from the property line so that the 100-foot buffer line has been met. Ensure that necessary buffers are met and markers are in place.
9. Drilling mud was observed within the inert debris stockpile. Disposal of drilling mud is prohibited in LCIDLFs. Ensure any drilling mud is removed from the inert debris stockpile and properly disposed of. Incoming waste loads need to be inspected at the front gate and unacceptable wastes rejected. 10. 15A NCAC 13B .0567 (c) (1) (B), “Post Closure Care Requirements…maintenance of the vegetative cover of the cap, and ensuring trees and other woody vegetation do not become established on the cap.” Trees and woody vegetation were observed growing on the northern and eastern side slopes and vegetative cover needs to be
mowed. Ensure any trees are removed from the side slopes and cap and that vegetation is rough cut/mowed to prevent woody growth. Landfill vegetative cover should be mowed at least twice a year. 11. 15A NCAC 13B .0564 (7), “The site shall establish and maintain an access road around the waste boundary for access by emergency or fire fighting vehicles or equipment.” A partial access road was identified around the waste boundary but remained incomplete at the time of this inspection. 12. Standing water was observed at the base of the compost pile on top of the landfill. This area needs to be regraded to promote positive drainage away from the compost pile. 13. Stumps to be sheared for the purpose of grinding are being stockpiled on top of the landfill cap, which is not in an area designated for grinding/chipping. A designated wood grinding and processing area is not depicted on any operations plan map. Please provide the Section with a map depicting all areas associated with the wood processing described in Section 2.10.2 of the Operations Manuel.
14. Dust was an issue during this inspection and should be managed in accordance to part 3.4 of the approved operations plan. 15. Corrective measures are necessary as a result of this inspection.
