The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility has been closed since 1995. LF had a recapping project in 2018 with some issues. Access limited
by gate. Records emailed by Mr. Kip McClary, included, December 2021 Annual GW monitoring report, which was reviewed. Some sample results resulted in higher concentrations than the NC2L standard. Please work with Environmental Compliance Branch Head, Perry Sugg, with Solid Waste Section at (919) 707 – 8258

2. Dereck Harris, Bladen County, rode Mr. Powell around the perimeter of the Closed MSW to inspect its current
state. Facility has EOW markers in place. Some not visible due to overgrowth and high vegetation along limits of the landfill. Please mow more frequently and maintain EOW markers. Any shrubs/trees with trunk smaller than 6 inches needs to be cut and anything larger than 6 inches needs root ball removed. Then soil should be replaced, compacted, and sloped according to approved plans. Document and create records for these activities and have available for review during future inspections. An engineer should be consulted with the larger tree/shrub removal to be sure cap is properly replaced back to original conditions approved.

3. Facility looks good currently, but more mowing could always be done more frequently. Most vegetation was grass and small weeds on top. Mr. McClary indicated that a contractor is coming soon to mow, but this is
needed more frequently than what is current period cycling of mowing.

4. Cut trees and shrubs inside EOW and address cap if tree trunk size warrants removal of root ball. EOW markers should be visible one to the other. Landfill needs mowing. Please continue to maintain the structure and mow/repair areas of concern when and if they arise. Periodically check EOW to ensure trees and shrubs don’t creep into EOW and for erosion rills. 5. Corrective actions are necessary as result of this inspection. Corrective actions should be completed within 30 days from the date of this inspection report sent. A follow up inspection will be conducted at that time or shortly after. Failure to resolve these matters may result in further enforcement action.
